Parking eye charge Adelphi hotel Liverpool

I parked in a parking eye car park by the Adelphi hotel I Liverpool back in July.
My boyfriend at the time said he had parked here before and said that you pay after you stay by putting in you registration and it will give you the time that you stayed and how much you need to pay.
So this is what we did after we did some shopping in Liverpool1.

However now months later I have received a 'final notice' ticket of £100 off paring eye and a letter from Equita.
This is the first lot of letters I have received regarding this issue and I am starting to worry as I have just sold this car so the car is no longer registered to me or my home address.

I am trying to find the parking ticket that proves I paid, however I can not seem to locate it at the moment.

I am unsure on how to fix this problem as I am certain I paid and am only 19 and scared this may affect my credit.
Can anyone make any suggestions on how to go about this?

    PE's signs are extremely unlikely to convince a judge that a valid contract exists.
    Can't agree there, DP, and nor did the Supreme Court, so lesser Judges are unlikely to view P/Eye's signs, with the parking charge on a bold background, as especially wanting. The only P/Eye cases we win (at POPLA) on signage are where it was dark and the signs were not lit, but this person read a sign and made a payment.

    @livvparry - probably P/Eye's unfair system where they expect you to guess how long you were there, and present you with a screen asking for a certain payment that is in fact merely the default for one hour (unless you change it, having guessed how long you were there!).

    Well worth defending against this lot, but you may not even get a claim.

    Makes no odds about the sold car. Why did you get no previous letters, was the car registered to an older address and are Equita now saying they traced you to this address?

    It will NOT affect your credit, not even if they send a claim form, and not even if you lost (as you would then pay the £175 and no CCJ would remain, at all, honestly. And you have a case to win, based on unfair and unclear terms displayed at the exit, if I am right that this was a place where they expect you to guess how much to pay and overtype the sum they display, which was likely to have been for one hour and not related to your time there at all.

    Anyway, no effect on credit is possible (unless you ignore a claim form, which you won't, and we will help you!)...as long as you confirm your address for service, so that all future letters come to you quickly, and that P/Eye do not sneakily revert to the old address.

    You can do this by filling in the data form on P/Eye's privacy page, and I strongly suggest you also ask for a SAR (see the NEWBIES thread 2nd post for a SAR template) and add a line asking for the data from the machine record as 'the driver' paid and no letters have arrived at all.

    And tell them too, to erase the data about your old address (if this is the problem as to why you got no letters) and ask for all letters & photos as part of your SAR. Confirm the new address clearly, even if Equita are using it, as this is the only thing that can cause a CCJ, if people don't know about a claim form going to an old address the PPC decides to use again.

    You could also reply to Equita telling them any debt is denied (but not talking about WHO was driving) and telling them that your address for service of all letters, is in fact xxxxxxx xxxxxx (your current postal address) and they and their client MUST rectify their data to erase the old address P/Eye used before.

Jut make sure that all parties have your correct address, and get that SAR so you have all the letters and photos and the machine entry, so that if a claim does later arrive, you are not defending 'blind'.

    If you move house again within 6 years of the parking event, email P/Eye.

    LAST THING TO DO (urgent, as this can get it cancelled) - send a strongly-worded complaint email (no phone calls) to the Manager of the Adelphi Hotel and ask if they will cancel this as it is harassing and distressing, for a paying motorist who knew nothing about it. Tell them that the 'pay on exit' system is unfair and not fit for purpose, and you bet they must have had other similar complaints as people expect the camera to link to the machine and tell you how much to pay, not lie about it.

    No telling them you were shopping...suggest you were ''looking at Hotel venues for a planned party this year...'' (that might get the Manager interested).

    Finally, I strongly suggest you contact the Forum Team, to CHANGE your forum username before you get any claim form, if that is your name...not good on this forum that PPCs read!

    I agree with CM on this.

    I think we're fairly confident that once PE farm a case out to debt collectors, they take no further direct action, they leave the debt collector to do the hassling.

    Debt collectors are powerless, restricted to sending out letters or making phone calls (block their number if you get a call). They cannot take court action against you, nor can they send anyone to the house to clamp your car or lift your 70" Samsung.
