Elite Management (Midlands) Ltd - suspension of BPA membership

After receiving a PCN recently, I search here on the forum for the company involved - Elite Management (Midlands) Ltd, based in Walsall.
Somebody on another thread mentioned the company was currently suspended from the BPA, but there was little other information. I decided to contact the BPA and get a bit more clarification.
“Are Elite Management (Midlands) Ltd members of the BPA?
I can confirm Management (Midlands) Ltd are members; however, their membership benefits have been suspended.
“Do they still have access to DVLA records?”
They cannot make keeper requests from the DVLA.
“If they are reinstated as members, will that give them the power to request DVLA details of people issued PCNs whilst they were suspended?”
Should Elite Management (Midlands) Ltd have their suspension lifted, they will only be able to obtain keeper details for charges that occur after the suspension.
Obviously the last point is the key one. I'm not making any comment on the company involved, but I hope that is of some assistance to others.

Just to add, this is from the FAQ here on this board:
"Q -''I got a windscreen PCN, I've checked the BPA & IPC lists of AOS members but can't find the company''
A - IF YOU ARE UNSURE, START A THREAD TO DOUBLE CHECK THE COMPANY NAME, BUT IF A PARKING FIRM IS NOT IN EITHER THE BPA OR IPC 'APPROVED OPERATOR' SCHEMES, OR ARE SHOWING AS CURRENTLY BANNED, DO NOT APPEAL AT ALL. THEY CANNOT GET YOUR ADDRESS AND YOU WILL NEVER HEAR ANY MORE!"
This is exactly my situation and maybe that of many others. I am doing absolutely nothing at all!0 -

If somehow they do, then that could get quite interesting. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

They are probably in financial trouble, the liabilities appear to be some £10.000 more than their assets. Complain to your MP.
On 18th March 2019 a Bill was enacted to curb the excesses of these private parking companies. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, and persistent offenders denied access. Hopefully life will become impossible for the worst of these scammers.
Until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -

There's a possibility (not a probability) via another PPC or a central bureau like Ranger Services which provides back-office service to PPCs.
It would be a very dodgy move indeed by a third party! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I have been a landlord for nearly 40 years. It has been my experience that the most troublesome properties are those where a high proportion of the tenants are in receipt of housing benefit.
I own a property in a block owned by a Housing Association. My parking space has been usurped on several occasions, sofas and fridges are dumped, food and soiled nappies have been thrown over the balcony, a window smashed, and so on.
In none of my other properties, which are more up-market, have I had these problems. I have had enough, I am selling the flat. You never know how far you can go until you go too far.0 -

Watch on iPlayer the BBC's Panorama about this character. Plenty of tips there on how to deal with tenants you want shot of.
