I once bought some beef in Morrisons that was not up to scratch (the top 25% looked nice, the rest was fat and gristle), took it back late on same day, manager was very apologetic, gave a full refund AND allowed us to pick whatever we liked as a replacement. As it was late in the day the fridge was a bit bare and all they had left was fillet steak! nom nom nom.

I once had an issue with the Make your own Pizza not being available twice in a row at Morrisons
The Manager's response was buy a pre made and go chose a free bottle of wine which I thought was very nice of him.
  • I once found about 8 cans of stella beer in a shops fridge that were a week out of date , I offered him 50p each for them

I was ill the morning after , I blamed out of date beer

Who remembers the days when only Marks & Spencer sold food with a "Best Before" date?

While forcing every other retailer to do the same is no bad thing, there is no "compo" to be had from buying food past it's sell by date. It's unlikely to be dangerous to consume such food anyhow..

There's a legal difference between a 'best before' and a 'use by' date though - a retailer can sell goods that are past their 'best before' date, but is not supposed to sell anything past a 'use by' date (as happened in the OP).

"Best Before", I agree and would use my own sight, smell, texture test to determine if ok to eat, although I would be a bit miffed to buy something that was already past this date.

"Use By" is a different matter, I personally would still give it some leeway, but be much more cautious especially with things like fresh chicken and fish.

It is also illegal to sell things past their "Use By" date with a shop liable for a fine of £5,000 per individual item.

But no "compo" for the unfortunate customer (who obviously failed to read the dates on the food he purchased)

Maybe, you should not have drunk 8 cans in one night

That's a lot of hassle for something that costs a couple of quid and is likely to get the same again in "compo vouchers".

What do you mean "hassle" ? I was just stating a fact about proving nothing, I didn't say do it!
