LBC letter from Gladstones

Recently received a second letter from Gladstone’s as a LBC. I followed the steps in the NEWBIES thread after the first letter, sending a SAR to Smart Parking and an email to Gladstone’s requesting they hold the data processing. Naturally I’ve heard nothing from Smart Parking and Gladstone’s declines the request. They’ve given until 22/3/19 to pay or give a reason for non-payment.
My major problem is that the car park itself no longer exists and I don’t have the ticket as I parked there at the beginning of 2017. And I paid in coins! Any help would be appreciated!

    You need to read post #2 of the NEWBIES thread to look at the action needed for a Letter Before Claim. It will also show you what happens when they raise a claim (which they will almost certainly do).

    It is irrelevant whether the car park still exists or not - it's for them to prove that the signage was there and appropriate. Chances are it wasn't appropriate.

    The SAR was a good move. When is the 30 days up?

    You tell Gs that you are seeking debt advice.

    That gives you the 30 day hold, that happily, coincides with the SAR deadline.

  • **Update**
    Another letter has arrived from Gladstones giving us another 14 days. This letter is dated 2 days before the original payment date. The 30 days from the SAR ended on 12th March - I’ve still heard nothing from Smart Parking. I find all this so ridiculous. Am I right in thinking that using the reply form for Gladstones is pointless? That seems to be the advice on the Newbies thread.

  • Thanks. No reply form was included at all. As the 30 days has passed from the SAR what purpose would another 30 hold serve? Kinda don’t want this to drag out any longer to be honest.

    To chase up the SAR and get it, so you can see their hand before defence stage.
    Kinda don’t want this to drag out any longer to be honest.
    Errrrm, well if you get a court claim next it will drag out for most of the year.
