Hi guys, I've read through a lot of posts and tried the above search for the newbies post, i can't find it and i looked a lot. So sorry for asking about this.
I've received a few notices, from different car parks, one dating back 4-6 months, I ignored them, I was reading through and it seems as they've now gone past the appeal dates thats all I can do.
one person I know, told me that he did this too ,he had to park in a tesco for a month, highview came after him with bailiffs after 4yrs, and demanded £1000 there and then, they had a court order to go into his property and take stuff if he didnt? I've now made sure I don't go over their stupid 2hr time limit, but have you guys heard of a story like this as nearly every post says they don't do this kind of stuff?0 -
they can and do take people to court and they can and do send bailiffs for unpaid CCJ,s, no doubt about it , they DEFINITELY do this stuff, providing they have a court order, issued by a judge (they have 6 years to do so)

I have emailed the BPA and provided them with all the evidence they asked for.
So far they have claimed that Highview are entitled to claim from the keeper and that they have no need to quote POFA 2012.
They queried that I appealed in time or in the proper manner despite evidence provided which clearly shows that I have and did if they read the evidence I provided.
Not hopeful so far that they will persuade Highview to provide a POPLA code at the very least.0 -
Complain to your MP. These parasites are being scrutinised by parliament at the moment and the BPA may not want to be looked at closely.
Make sure you let it be known the BPA are failing to control their members. Copy in the BPA.0 -

just for info , HIGHVIEW can access the DVLA database under KADOE and obtain RK details
they can then write to the keeper and invite them to name the driver
but if they fail to follow POFA 2012 then the keeper has no liability and so they should not say this , hence why PE change their NTK by omitting the liability paragraph if they failed the 14 day timescale (the golden ticket we refer to)
HIGHVIEW could try to adhere to POFA if they wanted to (they have had 6.5 years to do so), AS OTHERS HAVE DONE AND DO, but if they choose not to then THE KEEPER HAS NO LIABILITY and in any case there is no legal compulsion that means they must name the driver either
POFA is not mandatory , yet , but it protects a keeper unless they adhere to it
and naming the driver is not mandatory either0
