DCBL - Pre Enforcement

Hi All,

Sorry if this is wrong thread but i am not sure where to go with this,

Today i received a letter from the famous DCB Ltd (Can't Pay? We'll Take It Away), it notes i have failed to pay them for an outstanding balance of £358.66 which relates to County Court Judgement Number (########).

It also clearly states i have not made contact to discuss the repayment of the debt and they are advising the client to commence legal recovery against me via application to court.

It then also states on the back very small:
This case is not subject to high court and bailiff action.

It originates from Excel Parking Services Limited who somehow was able to get a CCJ against me by writing to an address i lived at over 10years ago and then just applying for a CCJ with that address, which to my amazement was issued.

I only discovered this information when being credit checked by the bank i tried to fight this but trying to make contact with court is really hard and soon i gave up and my busy life took over, what do i do now???

    Have you changed address during the period you have been the Registered. Keeper of the car in question?

    If you've got a CCJ registered against you, you should check your credit position with one of the online credit checkers. You may need to apply for a set aside, but you need to get to the bottom of things first, including calling the Northampton CCBC on Monday to find out what the current official position is with this. The phone line is horrendously busy, so expect a long wait on hold. The earlier you call might be advantageous, but who knows?

    are you stating that this address was different to the one shown on the v5 at time of incident

    I have since updated the post, Excel Parking deliberately contacted me at a previous address to get ccj issues another collection agency took over and agreed they did wrong and put it on hold and refused to deal with it, its since been resold onto DCBL who are obviously going to try bully the money out of me?

    I was in contact with Northhampton at time and they didn't seem very helpful other than asking me to pay some amount and send some documents i couldn't get hold of as i have never received a letter from them just found out from bank i had a new CCJ?

    The problem i had was i never got to deal with Excel about the matter as by the time i knew the CCJ was already issued and case passed to an agent.

    But even the agent released the original letters had been sent to an address different to my current address that they found quite easy as i am registered here on the electoral role.

    My memory is rather sketchy of this so still piecing it all together didn't ever believe it would get this far.

    What address was on your V5c and when did you update it?
  • if you cant be bothered fighting , then pay up

    you will get help if you want to get the CCJ overturned , but no sympathy if you cant be bothered

    I don't even know what car was in question as by the time i found out about this all i was issued was letters stating i had CCJ to Excel Parking, no other details enclosed.

    OK, then let's re-phrase the question...

    Has every car you have ever owned during the last ten years always been registered at your address current at the time?

    A yes or no answer would be a good start.

    At the time i buried my head like most, i formed my own first business and its drained my time as you can imagine my entire life has been put on the backburner and i'm now suffering.

    i do want help and i have to fight these people, it is criminal what they do.

    sorry if my posts seem confusing for as if i dont care but also trying to get my head around what has happened has it has happened in a way where i only found out about the charge when my bank said i had a ccj.

    None of my vehicles have been registered at the address they wrote too.

    I also didn't live at the address and hadn't for some time, i struggle to understand how they found the address tbh.

    When i found out i called Excel, who told me to contact another company who now owned the debt after some digging around even they admitted some wrongdoing and passed the debt back to Excel who have since sold it to DCBL.

    My last communication was awaiting the original letters from Excel, which never arrived.
