    When the bins were emptied last time there was 5 large containers emptied. How an earth am I to get this in my car?? And why would I PAY to have my waste and my neighbours waste taken away? This is what the council are meant to do

    I cannot dispose of my own waste as well as my neighbours.
    Why not? I'm sure plenty of people would be prepared to be paid to take away your rubbish, what do you think businesses do with theirs?

    Because it's cheaper than paying for your Range Rover to be fixed.

    Ok its "our" waste. 4 flats worth

    Businesses pay to have it taken away because the council do not have an obligation to collect their rubbish. Does everyone really think its ok to have 1 bin collection since 14th December ??

    No but its no good asking for advice on here if you have a fixed view and dont want advice that is different .
    Personally i would be looking at legal advice not unqualified forum advice .

    I don't think anyone is claiming it's ok, just that there are probably legitimate arguments against your claim being as high as it is.

    I completely understand what you are saying. It is however extremely frustrating and angers me that the council cannot arrange the simple collection of waste for such a prolonged period of time.
    It was only when I checked under my car bonnet on 1st Feb that I noticed the damage, the bins were collected on 5th Feb. If I had known the rubbish was causing such a large scale rat infestation... I wouldn't be having this conversation.
    Yes I am considering legal advice but naturally I wanted to get other advice and opinions beforehand. I hope you do not see it is argumentative I just feel the council have a responsibility to collect waste. I appreciate that taking rubbish to the dump is an option however I have neighbours that simply do not have the option or finances for someone else to do this and if I was to do this for all of my neighbours I would be paying daily visits to the dump (working 8:00am-7:00pm everyday simply does not allow me to do this)

    I'm curious how the rats damaged the land rover and why. The only time I had rodent damage to a car was when I stored a couple of 50kg peanut bags in my Volvo. I found out in a day or two and removed the nuts. (Did not stop them eating the wiring though)

    Sounds like a nightmare (and let's be honest, not surprising).

    I would say that "mitigate your losses" in this instant isn't really about removing the rubbish by other means (although you could argue you personally tried with some of your rubbish, but everyone else just kept on piling on). In this case mitigating your losses is making sure you didn't park there after you found out about the damage. I'm assuming you didn't? Any damage caused after this point could be argued negligence on your part.

    I dont see why any claim for damage up till this point would fail, especially if you have logs of multiple attempts to warn the council. Not really any different to a pot hole claim.
