BW Legal / Brittania - scared of court

I have been chased by Brittania for 3 years over a PCN claiming I had not purchased a valid parking ticket on a carpark in Stafford.

3 different debt collectors have been after me since day one. Unfortunately for them, I keep my parking tickets in a clear wallet on my windscreen and was able to prove I had a ticket, so one by one they backed off.
Then BW Legal parasites started hounding me. But by now I was p**ed off with all the letters emails,phone calls from morons, so decided to let them take me to court.
I responded to court as soon as the letters arrived stating my defence.
There then followed regualr emails from BW Legal advising that if I agreed to pay £289 I would save myslef court costs etc, and it would go easier on my anbd all that bulls*it.
I called their bluff and stated-politley- I would let the courts decide, and if the court ordered me to pay £289, then I would do so, but I would be citing their double charges and delusional cost claims for servies etc.

I then received letter from teh courts asking to advise witnesses etc, court for hte hearing, and if I wanted mediation.
BW had requested mediation, so I figured, what the hell, lets have a party! I contacted mediation to acknowledge their letter.
Yesterday-March 12th 2019, BW Legal sent me a very nivce letter offering to reduce my "penalty" to £180 as long as I paid up within 14 days, to save me the expence of going to court, and facing the humiliation of my having to be examined by a magistrate!!

I guessed, correctly as it turned out, that they did not want to actually go to court becuase it would cost them more than tehy were chasing me for.
I did some sums and worked out, it I had to attend court, a day off work would cost me £160.
I responded to their "lawyer", Mr P Byers-Nolan that I was interested in their offer to reduce the claim against me to avoid court, but unfortunately I was low on funds and though it was a very generous offer, had no inclination to take out a payment plan, having read bad reviews on their process for collecting payments etc, and as I didnt get paid until after the 14 days deadline was over, I would have to wait for the courts to decide, as I only had £90 disposable income in my bank account and if they were that desperate to avoid my humiliation in court they were welcome to take my last £90 in full and final settlement of the matter!
! hour ago, I received the following email from said lawyer, stating:

Subject: RE: PYBE/T1002552
WITHOUT PREJUDICE SAVE AS TO COSTS

Dear Ms

Further to the below email, my client has confirmed that they will accept the sum of £90.00 in full and final settlement of the matter.
Please contact our office to make payment.

Stick it out, and they will ALWAYS back down if they realise youre not intimidated by them.

Hope this helps some of you. I might just have struck lucky, but it proves what scammers they really are.
I am not contacting their office, I have replied that when he sends me the formal offer in writing I will pay the £90 by bank payment. Theyre not getting their grubby little hands on my bank details!

    You actually think paying £90 is striking lucky? No-one here would pay that stupid amount. Have you really got a claim?

    If so, tell us you are NOT going to pay anything and not doing Mediation. NO-ONE would pay that, or even 90 pence!

    I would have thought that going to POPLA and paying nothing would have been a better result.

    Failing that using the tried and trusted defences in the faq here and paying nothing would be an equally better result.

    Best way for you to get our trust is scan the letter/email, upload it to a free site and show the link here.

    This then can be shown to others how BWL work and that being the first step for BWLegal to discontinue

    From £289 to £90 ???? Offer them £5 for a cup of coffee in full and final settlement ..... they might even pay you to back off ???

    If this is genuine, it does add weight to the forum assessment that this latest 'marriage' between BWL and Britannia (and BWL/NCP) will unravel when resistance is put up (decent defence) and after the first sign of an offered reduction in the charge, discontinuation is but a couple of further steps away.

    The OP won't be paying £90. Not even a scared poster is that naive.

    Still waiting to hear from the OP again, with a picture of her claim form (redacted) and for her to say she is real and has come to her senses and realised this is not a 'result'.

    It's safe to say that members of this forum are far smarter than BWLegal and that other lot ?

    Same old ... same old ... without due care to what actually happened.

    Before BWL entered into the parking scam they were probably dealing with normal debts, not the scam rubbish.
    They have now evolved into bullies hoping to get their way with the most ridiculous letters. Desperation comes to mind
  • I cannot believe the rudeness and vitriol from some on here in response to my post.
    I did my homework, knew I had a reasonable defence and would probably win in the end, BUT, I dont have time to be arsing around on forums and web sites looking for a way out so after discussing the issue with my tutor (Law Tutor!) and after weighing all the pros and cons of proceeding to court, where I possibly would win, I would still be out of pocket to the tune of £160 in lost earnings!

    As such, paying £90 is definitely a win to me, get the paraistes off my back, and proves a point for those who do not wish to continue with the constant harrassment and threats of ever increasing costs. My post was simply to let them know that if you stick to your guns, they will back down as THEY are the ones scared of going to court-NOT ME!!

    As for posting a copy of the letter accepting my offer- I cannot find a option to attach a pdf so you'll have to do without, but to be accused of being in collusion or even lying says more about the arrogance of certain people on this forum.
