Hello all,
So I’m in a bit of a pickle back in April 2018 on was on way to work when my car broke down on a main road. I managed to push it into the xxxx in xxxx didn’t realise at the time I had pushed it into a disabled spot I was on my own and it’s an SUV so wasn’t easy. and explained to the receptionist my situation, her reply was its monitored by a private company that occasionally pop round.
I left a note on my windscreen saying, broke down pick up is at 19:00 with contact details, this was done at 16:55. Went to work meet the recovery driver at 19:00 to find a ticket on my windscreen, THIS IS NOT A PARKING CHARGE NOTICE, with a reference number on the back and details of a website to entre that information. I obviously did not do that as I thought this is not a legitimate ticket. The ticket was issued on the xxxx at xxxx the NTK was received on the xxxx.
I also did not respond to the NTK, more letters were sent and binned up until now. I been away working and on return have had a letter from county court business centre I have filled out and sent away the acknowledgement part of the form, the defence form now needs to be complete and sent in before 22nd of March.
I have noticed in the particulars of claim that there is a difference in the time xxxx in the POC, but on ticket it says xxxx
I have images and will try to figure out how to attach them. Any help or advise that is able to be given to one in my situation would be greatly appreciated. I was advised by a work college come here for advice, wish I had of known about this forum earlier. Many thanks in advance.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. It has cleared Parliament and hopefully, this will become law shortly.
    You never know how far you can go until you go too far.

    What is the Issue Date on your Claim Form?
  • Looks like your going to Court then, bit of aggro for you but not the end of the world as you have a legitimate reason for 'parking' there and that will form part of your defence.


    First port of call, read NEWBIES section on Court claims and follow the advice, then write your defence and post it here for the very experienced regulars to help you hone it to perfection.


    I personally think you stand a decent chance of claiming your costs (capped unfortunately) in Court as any decent Judge will not agree with you being penalised for your vehicle breaking down.


    You also need to gather as much evidence as possible and one of the biggest pieces will be PROOVING your vehicle was recovered, was this done professionally OR a pal with a toe-rope? either way I don't think it will matter apart from professional recovery = written evidence/invoice and pal with toe-rope = Witness statement. (you'll understand what I'm saying by READING LOTS on here)


    Take it all a step at a time, parking scammers couldn't care less whether you have a legitimate reason to park or not, they are only interested in £££££s.

    Thank you for your response, Contravention reason "park in a disabled space without clearly displaying a valid Disabled Persons badge".!
    Yes I can prove I was at work at the earlier time.

    That's two weeks away. Loads of time to produce a Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Hello onlyfoolsandparking,
    I will be reading up over next couple of nights and then post my defence over weekend, gaining evidence of been recovered is not a problem can also provide work done to car. Thank you for your response.
