Parking Eye - Liverpool Adelphi Hotel - Advise needed

Hi Guys,
I recieved a parking ticket in the mail since I am the owner of the vehicle charged for overstaying by just over an hour on a 12 hour stay.
A few things I would like advice on -
1. If the machine took money and the return button didn't work so it just swallowing it and it was an unfunctional machine could I use this in appeal (unfortunately I don't have the evidence besides if fthey count how much money the machine has that hasn't been used for tickets or know that this machine was disfunctional).
2. I am unsure on this one completely will check again when I go past the car park this weekend but I seem to remember from a previous trip there that the prices on the machines do not match the prices on the signs. If this is so and I can provide proof can this be used? (I think it was £10 on one £12 on another for 12 hours)
3. Can you still use the newbie thread appeal template or is it outdated? and how would I fit above points into it.

Have you got a Golden Ticket, that's the important question? As per the NEWBIES thread post #3 about POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

A common problem. Best to tell this to the hotel management because if Parking Eye is stealing your money, you are not alone in that car park. The hotel needs to cancel this because your options are many0 -
The driver was not staying at the hotel at the time so I can't go to the hotel over it.
Also when appealing and it says reason for appeal, should I put not driver of the vehicle at the time or other?0 -
No you just put other. Whilst you appeal as keeper, you don't lie about the driver.

I do not have a golden ticket and from memory the signs are clear with the penalty price so from this i can only rely on No evidence of Landowner Authority - the operator is put to strict proof of full compliance with the BPA Code of Practice and The operator has not shown that the individual who it is pursuing is in fact the driver who may have been potentially liable for the charge. Going of what was said on the newbie thread.

the chances are that it will be rejected by PE , by POPLA , by a judge and by the ADELPHI
in order to win, it has to be on a technicality, the difficulty is finding that technicality , that chink, so you have to be better than BEAVIS because that fight went 3 rounds (in court) and he lost every time , he lost to PE and he never tried POPLA afaik
you may win, but dont ask about "chances" because its likely that PE have covered all the loopholes0 -

You can't use the second template as you said they used a POFA PCN.

You can try a complaint to The Adelphi (the manager, not the receptionist), but from past cases here, even as an organisation that relies on customer patronage, they are likely to show a wanton disregard for you, just as soon as you've checked out of your room and paid your room charge.
Why do they think that any genuine guest 'rewarded' for their custom by being abandoned to a predatory parking outfit is ever likely to return to provide business to them again?

not true at all (sorry to be pedantic but you need to understand this GAME you are caught up in and how the pcn arrived and why)
the NTK came to the KEEPER of the vehicle, the person listed on the DVLA database
there is no register of OWNERS, the "owner" could be Toyota Finance or Barclays Bank for example
PE accessed the DVLA database, got the details for the keeper and sent the postal notice to that person (or company in some cases) - in this case , KEEPER (so a Notice To Keeper , or NTK for short)
signage issues and landowner contract discrepancies are your main arguments here, and possibly frustration of contract if the machine was faulty
in future , the driver needs to keep the paid for receipt, as MSE advised 2 years ago

this is a complicated topic with various things you need to swot up on, but sometimes people are "guilty" of their actions, so the need to cast doubt on the contract , poor signage and machine failures is paramount here, especially due to the fact that this particular car park has caught many people out who have come here for advice, usually without much luck as Britannia couldnt care less0 -

Regardless, don't you think the hotel should know what is happening in this car park ??
Parking Eye will lose the hotel considerable business with dodgy machines, most customers will think it's the hotel who are ripping them off ....... The hotel needs to turn off the power supply to the PE system until there is a full investigation
