Hi, I just went through the Newbies thread, but one question now remains.

A driver got a parking charge notice from a college, where they are studying, due to not parking within the bay markings. Basically they parked next to the bays, since the parking was full (no yellow lines, not on anyone's way or anything).
Anyway, they've got permits to put on the windscreen and there's an "Attendant Badge No." on it, which can be tracked to them.

Question: can they say that it was "the driver" who parked there, since it's on the permit (no name, just a badge number)? They also got cameras around.

Already checked the BPA list and they are presented (F1rst parking). As I understand the keeper has to wait 26 days and then appeal it as a next step.

The driver is thinking about complaining to the college as well, but if they do, then the college will know that it was "the driver" who was driving? So should the driver still do it?

Sorry for the new thread and more than 1 question, the more I dig into it, the more questions it raises..

    Scammers monitor this forum so could determine who was driving because you have told them in your post above.

    You should edit it to remove information about who did what and only ever refer to The Driver and The Keeper, who are two different people.

    If you were "an occupant of the car" ;) then of course you can complain to the landowner and send the initial appeal around day 26 as keeper without revealing the driver's identity.

    Please also complain to your MP about this unregulated scam.

    Should the complaint be made before the appeal?
    Which MP should be complained to? I guess the area's MP where the car was parked?

    You always complain to your own MP no matter where a problem is. They are the ones who represent you.

    Just be careful with the complaint.

    As we said, you were an occupant of the car (friend with a licence & their own insurance could easily have been driving it).

    Apart from that, appeal as keeper on day 26 and remove the phrase about PDT machines/VRN lists from the template. Obviously!

    The driver was not the registered keeper anyway.

    Thanks for the help, a complaint will be made to the MP.
    But when a complaint to the college should be done? Should it be done now or at the day 26 as well?

    As I understand the parking operator needs to send out the NTK to the keeper, which means there are no proof that the keeper knows anything about the notice before the NTK, which leads to think that the complaint needs to be made after the NTK is received?

    Right, but you know the appeal must be done by the rk, not the driver?

    In the NEWBIES thread it explains EXACTLY why we use the 'appeal on day 26' tactic.

    Please read it and you will see why the above is a daft idea (sorry). Do you WANT them to be able to issue a NTK that they can then show POPLA and ruin your argument about keeper liability? No, didn't think so...!

    Yes, the appeal will be done by the RK.

    I understand the reason behind appealing on the day 26, but I don't understand the complaint procedure.

    The APPEAL will be made on the day 26 - that will definitely happen.

    But does the RK have to make a COMPLAINT to the college straight away?

    Let me make an example:
    A driver gets a PCN and won't tell this to the RK. The RK has no clue about the PCN before they receive the NTK or any other paperwork from the operator. How is the RK supposed to make a complaint about anything they are not aware of? That bit is a little confusing.

    I will go through the NEWBIES thread again, but I didn't find the answer last few times I tried to understand. It's probably my own fault I can't find the answer, but at least I try :)

    I went through the NEWBIES thread again and as I said - it was my mistake I didn't find the correct part about the complaining to the business.
    ALL CASES - COMPLAIN FIRST, ESPECIALLY OVER A RETAIL, HOTEL, OR HOSPITAL CAR PARK:

    But that still raises a question, how can the RK know if there was an NPC if the driver won't tell them? Or do I understand everything wrong and THE DRIVER needs to make a complaint?

    The keeper makes the complaint. The keeper has clearly been told by the driver, otherwise how can the keeper appeal on day 26?

    Oh, okay, got it. So you always have to make sure the keeper is aware of the NPC (in this case - they are).

    Okay, thanks for that. Now it's time to figure out how to make a complaint on this topic then.
