Newly purchased car has problem need advice on my staturatory rights as a buyer
Hi everyone. I need help with drafting a letter to send with a copy of an invoice for work done to my newly purchased car.
A bit of info on the issue:
I bought a car in February which after 3 days the engine management light came on. It turns out the DPF is clogged forcing limp mode. I bought it from a trade seller who sells cars off his driveway.
I went back to the trader via telephone last week, outlining the sale of goods act etc and was told that it did not cover the issue as its part of the exhaust not the engine.
I said thats not true, it doesnt cover worn tyres and replacing windscreen wipers etc.
He gave me the details of the car garage he has his repairs/MOT through and unsurprisingly, got taking to the owner and he said the guy is talking rubbish. The regen of the DPF cost me £150 and its not an unreasonable cost for him to pay.
The mechanic also went on to say that either the guy who I bought the car from or the trade agent he purchased the car from MUST have fiddled the fault codes to fool it into thinking there was no problem because the DPF was so full of soot there’s no way the light would be off for any other reason. The amount of soot in the DPF also meant that I could not force the car to regen itself by driving down the Mway in 5th gear!
So I’m writing a letter, this is the bit i need help with!
I have a copy of the invoice from the garage, I have a copy of the fault code print out from Kwikfit which i had done on the day the problem occurred. I am going to send him both with a strongly worded letter. I want to have him compensate me for the cost of the fault code diagnostic £35 and the £150 cost of regen.
:j Can anyone tell me exactly what my staturatory rights are as a buyer and which legal jargon i should be quoting please? If anyone has successfully sent a letter and wouldnt mind sharing it that would be very welcome too!

It's all confusing..... if the car wasn't brand new then depending on how it was previously driven may leave it in a state that the regen needs to be executed.
Saying the independent 'expert' who wasn't present has concluded what MUST have happened, isn't logical.
Then you mention KF, aren't they the ones that do a free brake check? an off the production line vehicle could appear a scrapyard reject to some of their outfits.

Taking it to Kwik Fit was a massive mistake. I wouldn't trust them to tell me the correct time unless you pay a fortune.0

Well i wouldnt normally go there but it was a Sunday and wanted a fault code diagnostic to make sure i could drive my car from Newcastle home to Manchester without it breaking down enroute. If i was really stupid I would have gone with their advice which was to replace the DPF at a cost of £1500-£2000! Lolz as if!
Turns out the fault code reading was accurate so problem resolved. Happy days.
Regarding the advice i was asking for help with, its all sorted now. Found a template on the MSE site. Cheers :beer:0 -

Good you found the template - unfortunately I don't think you will have much luck getting your money back as the supplying dealer should of repaired it.0

no one has said anything about what kind of mileage you do, if you do low miles per year and lots of short trips, you are going to get this problem time and time again. A diesel with a DPF needs a good run to keep it clean. Previous owner might have been a low miles driver and got rid of car because of this problem.0
