I help my nephew who has a mental health issue. I manage his finances and bills etc and I generally help him in anyway that I can.

My nephew was about to board a bus and threw a cigerette end into the gutter. He was fined £100 on the spot. He didn't realise it was illegal to do this. He hasn't got £100 to pay the fine and if it isn't paid within 14 days, the fine increases to £150.

Other than pay the fine for him, is there any way he can be helped with this? It would be nice if there was a first offence ticking off before an on the spot fine.

    Sorry he was caught littering, obviously got away with it in the past?

    You can pay his fine, but feel that if he is spending around £12 per pack perhaps he has the money? Might do him good to give up for a bit.

    Government guidelines say:
    Enforcement officers: issuing fixed penalty notices

    Enforcement action is inappropriate or disproportionate

    Don’t issue an FPN in the following cases:
    • it’s not in the public interest to do so
    • the offender is vulnerable
    • the offence is trivial

    So if you feel that your nephew is 'vulnerable' (in the legal sense), you could try appealing.

    I'm sure my nephew isn't spending anywhere near that amount and he has certainly learnt his lesson. Wondering if anyone knows if I can arrange to pay his fine in installments and have it fixed at the £100 as he won't be able to pay it within the 14 days.

    My nephew has a very sad life - he didn't ask for his issues (genetics) and I would not begrudge him his pouch of tobacco. To inflict a huge fine with the intention of increasing the penalty in 14 days will exasperate his mental health.

    Some fixed penalty notices can't be appealed, you'll need to check what it says on the notice he received. It depends on the local council that issued it.



    He may also not be able to pay it in installments because it has to be paid within 14 days for the reduced charges, otherwise it will be increased.

    I think it would useful if you wrote on his behalf, much as you have above. You haven't said whether you have a Power of Attorney, or act on his behalf on some formal basis, perhaps as a Court of Protection appointed Deputy, or Personal Appointee, but if you have any such authority I would quote this.

    You can explain his condition and that he is now aware that he should not litter, and you are certain that he will not do so in future. All this might help negotiate a better outcome for him.

    My post stated that the op could pay the fine but the relative seems to be able to afford it and basically should. Giving up some tobacco for a while would be a benefit.

    And your post was useful to the op in what way? Do you not always find if you have nothing useful to say it is best to say nothing?

    Maybe the tobacco is a coping mechanism?

    You could certainly say that! The poor lad has had a very sad life and none of it his fault. You always get some horrid judgmental person who just likes to stick the knife in.

    I am my nephews official appointee and I will write on his behalf. My nephew is a very good lad and he immediately picked the cigerette end up and apologised sincerely. He has learnt his lesson and a £100 fine to a vulnerable person is not a good idea at all.
