I'm sorry if my opinions of my experience in dealing with VCS and Northampton Country Court Business centre upset KeithP and Coupon Mad, I was just trying to give anyone in the same situation an idea of what to expect in regard to this flora street car park, when people look on line for help they normally end up on this site and one woman who I spoke to found it all very confusing going through the Newbie section and said she wish she could see a simple step by step of what to expect, you guys are on this site giving your time in helping people all the time with this mine field of rules, regulations, and advice, which is probably like second nature and easy for to understand, you don't get enough credit for what you do to help others dealing with private parking firms.

To Anyone else who sees this thread in the future,
I have Defended my brother on this case of alleged breach of contract or parking in a restricted area of the car park Flora Street, the area in question is a blank area of the car park with no markings or clear signs on the floor of the area specifying it is a restricted area.
My brother asked me to help in this matter and I defended him on his behalf because he knows I'm a person who loves challenges like this but I found VCS were a disappointment and I was really expecting more of a challenge, I pushed the case right to the end and wanted it to go to court but unfortunately the judge threw the case out with a simple letter basically saying.
Upon the material time the defendant car was parked in the blank area of Flora Street retail car park.
And Upon the court having determined on numerous occasions motorists have not breached any terms of contract.
And Upon this case having no real prospect of success and that there is no other good reason why the case should be disposed at trial.
The summary of judgement is entered for the defendant.
The claim is dismissed.
I have done my research and found
Sheffield County Court are well aware of VCS continued persistence of trying to fine motorists in this car park and are ruling in the favour of the defendant.
Anyone who is issued with a PCN is not breaching any terms of contract with VCS regarding the alleged parking in a restricted area,
Do not pay VCS for there invoice letters, you will receive the following.
1.Letter demanding £100 but reduced to £60 if payed within 14 days
2.Letter now Demanding payment of £100
3.Letters now Demanding payment of £160
4 Letter From Northampton County Court >( BUSINESS CENTRE )< Requesting Paymant of £185.
Please note Northampton County court BUSINESS CENTRE unfortunately has no court rooms or judges and the admin staff are not legally trained to answer any legal questions, which I found out when talking to them unfortunately for them.
It is basically a Business Centre with a company called Money Claims which works on behalf of private parking fines to get you to pay.
When you receive the letter from Northampton County Court Business Centre it can obviously scare alot of people into believing this is it, I have no choice I must now pay up, but that's not the case until it gets to a the real Courts.
When you receive the letter from Northampton Country Court business centre just do the acknowledgement of service which is replying to them with your defence within the time period specified.
The next letter you may then receive is requesting if you would except doing medation over the phone between you and a member from VCS and a so called independent from Northampton County Court, (WHICH A REAL COURT WOULDN'T DO), this would require you giving them your phone number ! Which they don't have.!
This is there final attempt to scare you into believing you will lose in court, they will talk you into paying them the money and they will probably offer you the chance to pay a reduced amount.
Refuse this offer of Medation it is only there for the benefit of the claimant VCS, just fill in the section of the form informing them which Court you would like it to proceed to, which will be The Law Court at Sheffield, seem as the alleged offence location being Flora Street sheffield.
VCS are losing the cases regarding this Flora Street car park because of there lack of responsibility in not marking the area out in question with No PARKING or RESTRICTED AREA on the floor.
I can only sum up my experience with dealing with VCS as been very similar to the scammers who phone you up pretending to be your bank asking for your bank details so they can take your money or some other form of online scam where they try to get you to part with your money, they are very unprofessional and will try to use any method to scare you.OK, I didn't realise I was going to cause this kind of hostility from you guys on your forum, when I'm back home in a few days I will be able to use the PC to just completely delete everything I put on your forum, I hope you catched your breath KeithP.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

The Flora Street scenario is interesting. Sounds similar to the Derby St Car park in Burton. Upstanding and Keep Calm are defending claims on the same basis (restricted area). Keep Calm has already won a claim regarding markings on this car park.

I was thinking that I need to edit into the template defence, at the end (as well as adding the new statemet of truth and the paragraph from ParkingEye v Somerfield about adding £60 being a penalty) a sentence inviting the court to not only dismiss this claim but to step in and impose an extended civil restraint order against the Claimant and/or their robo-claim solicitors.
Seems a fair point to add to PPCs who keep adding £60, and certainly relevant to VCS claims about Flora Street. If Sheffield court have sussed VCS why are they not protecting all consumers and not just those brave enough to defend?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have been reading your comments and advice with interest as VCS and Elms Legal applied to take me to court for parking in the “restricted” area of the Flora street Carpark. I parked there 3 years ago and it was to be heard before a judge on 11 Jan 21 by telephone hearing. About a week ago Elms Legal sent their notice of discontinuance. So I’m happy to tell you that another success can be chalked up.4
