    Transcripts - nope, not available unles you pay.
    If you just want the summary at the end that shouldnt be as much - maybe £100. Have to go through the courts though, you cannot profuce your own.
  • Well done, VCS have lost several times now in court with this 'restricted area' claim/scam for Flora St.

    It's great that the Judge is aware of the scam and saw fit to award you hefty costs. Another smack in the eye for VCS costing them quite a few quid.

    Unfortunately there will still be many motorists caught out with the scam that cough up and pay the PCN. So VCS will carry on with this honeytrap.

    Hopefully though they might now be deterred from bringing more Flora St. claims to court. I doubt it though.

    Great! Which court and Judge 'always finds in favour of the Defendant' about cases like that one? It would help us to know, for other people with Flora Street cases.

    Lovely to get all your costs as well, but be aware you will likely have to chase VCS and threaten them with a Warrant of Control if the cheque for the costs fails to materialise.

  • Sorry to hijack the thread, but I have just received the dreaded LBC.
    The keeper of the vehicle is actually my other half, but she is not confident enough to challenge the PCN.
    May be a stupid question, but is there anyway I can do this on her behalf (including court if necessary) without letting on who the driver was??
    I have also not challenged or replied to any of their letters yet.

    Read the NEWBIE sticky and then, if you still have any questions, please start your own thread. It is forum etiquette NOT to hi-jack threads. And the answer is No you cannot, you can do all the research but the appeal must be in the other half's name and the other half, if it comes to it has to appear in court, although you can be a lay rep or McKenzie friend.

    Apologies for the late response, but I was unsure of the name of the judge. I've just had the Judgement through the post, and it shows that it was District Judge Gosling at the County Court at Sheffield.

    In other related news: a friend was coincidentally due in court for exactly the same contravention in the same part of the Flora Street car park, and last week she received a letter saying the claimant had dropped the case. The rep for VCS at my hearing did say she was going to have words with them, seems like she got through to them!

    Thanks for posting about your success and so glad that Judges are striking these out.

    The only part of your account that's not quite right is this:
    The next letter you may then receive is requesting if you would except doing medation over the phone between you and a member from VCS and a so called independent from Northampton County Court, (WHICH A REAL COURT WOULDN'T DO), this would require you giving them your phone number ! Which they don't have.!
    Mediation is a normal feature of the real county courts in England & Wales and that was exactly what is offered to all parties - but we agree not to do Mediation with any PPC!

    This is all already fully covered in the NEWBIES thread post #2 which tells everyone how to defend and win and what to do when. We win almost every case here but it's great to see some Judges acting to strike a claim out. Well done on the win!

    We work together with county courts of England and Wales. We only handle the administration of cases. Cases which need a court hearing will be heard by a District Judge or Circuit Judge in a county court.
    I can understand why they were unfortunate to be speaking to you but I don't think you uncovered any secrets.

    Yes, it is a Business Centre, but where did you get the idea from that there is "a company called Money Claims"?

    A County Court Claim can be raised via the County Court Business Centre or via any County Court in England or Wales. The process is the same. To try to create the impression that the County Court Business Centre is somehow something less than "real Courts" in this context is a mistake.

    Every County Court, and I include the CCBC in that, assesses each case and decides whether or not to offer mediation.
    To suggest that a 'real court" would not offer mediation is simply wrong.


    Still, your tactic seemed to work. Well done.

    But for others reading this thread please be aware of some of the misunderstandings in Johnson14's post.
