2019 Euro Car Parks Penalty

New here!

I have read several threads on this and as they are old now so thought to create one to check if Euro Car Parks are still a scammer and if I should ignore their letter.

I received a letter from Euro car parks with my number plate with timing and date - asking me to pay £50 or £85 if delayed.

I would like to know if I should pay for it?

Context: we went to the restaurant but parked our car in wrong car park (other restaurants) without realising the error we went to dine and got back home. However, today we received this penalty notice. I spoke to the restaurant and they said its your fault that you parked in the wrong car park and they cannot do anything.

any advise as what should I do?

    you can either pay it or appeal it, but do not IGNORE it

    the worst case scenario is they could take you to civil court within 6 years in England and Wales


    ps:- I do not believe you when you said PENALTY notice


    it will be a Parking Charge Notice (PCN) - which is an INVOICE

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .
    You never know how far you can go until you go too far.

    It seems like I made an error so there is no chance for me to appeal. I guess i will have to pay the fine.

    You need to read further. This isn't a 'fine'.

    Did you see the signs that distinguish one car park from the other? What exactly did the sign say in the car park you mistakenly used? Do you have photos of the signs? Was the car park pay & display, time-limited, permits only, customers only? Do the signs comply with the BPA Code of Practice?

    On what date did the contravention take place? What is the issue date on the Notice to Keeper (NtK)? Is the NtK compliant with the Protection of Freedoms Act 2012 (Schedule 4)?

    There's a set of questions that you need to consider as your starter for ten, before you even contemplate paying, not a fine, but a purely speculative invoice.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    As said, it's the signs that matter, how a motorist sees them especially in the dark

    But in all seriousness, go check out Post #1 of the NEWBIES thread. There is even a template appeal, all written out for you, so minimal work on your part.

    What can you expect next? Well, depending on the outcome of your appeal to Euro Par Carks, you get the chance to go to POPLA and appeal to them.

    There is NO FINE.

    ECP sue no-one, and I have ignored their letters myself more than once!

  • Hi new here!

    I have checked the newbies and can’t seem to find a resolve and the stickies thing has vanished. So I ignored first few letters (I never received a ticket, just a letter). This has now been escalated to Debt Recovery Plus.

    So I have missed appealing to popla, any advice on what to do next?
