Hi, I’m just wanting so advice on what to do!! I was parked on the street, ran into a shop, came back out, got into my car and as I began to close my car door a bus pulled in and snagged on my car door!! I believe if he had of checked his wing mirrors before pulling in this wouldn’t have happened.. now the bus company are saying I am at fault etc but I don’t believe I was as they where under the illusion I was exciting my car and opened my car door on to the bus, which neve happened and the cctv on the bus will prove this, we’ll at least I thought that but they’re still saying I was at fault however I do not believe I was responsible for this, so I had to let my car insurance no about the incident, so they’re currently fighting my case, saying there is no evidence to back up the bus company’s accusations, but I did not want to go through the car insurance as I don’t want my premium to increase!

I cant imagine a scenario where the bus driver would've seen OP in wing mirrors but somehow managed to snag a 30% open door. More likely to swipe the front/rear of the car (depending on which way it was facing in relation to the bus). Which then makes me wonder where the bus was when OP opened the door to get in.

OP, sorry - I know you weren't asking for posts like this but its the internet (unfortunately cant control what/how people respond) and we're really in the same position as the insurance companies. We weren't there so we can only go on the circumstances described. It could potentially help you clarify matters to the insurers.

As for only being a pedestrian at the time....your vehicle was in an accident. That makes your insurer potentially liable. Even if you weren't in the car at all. Even if it was a friend (ie not named on your insurance) who opened the door. Is it fair? Not really, but such is the nature of insurance! You can sometimes get reduced premiums for having a black box installed - which can be used your assess your risk rather than just statistical analysis on its own.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
