BWLegal have offered a final settlement fee of £150.00, after I offered to pay the original reduced amount. This is a final offer.
Looking at their response to my defence, they've essentially said 'grace periods' do not apply, as they're used to allow motorists to consider the Terms and conditions and familiarise themselves with the parking site. I have stated the driver was picking up a passenger, therefore I've breached the terms and conditions. This bit scares me a little.
However they've also stated i don't need to deny any breach of contract as "the performance of parking (as opposed to leaving) in accordance with the Terms and Conditions is the act of acceptance".
This is interesting as you can see in my defence I denied that the driver ever parked at all. I also went back to the car park a while ago, and sure enough, the signs say 'by parking in this car park, you are agreeing to..." blah blah. Don't know how well this would go in court but its worth noting.
So what do you guys think? How much of a chance will I have if I go to court?
Side note- if you feel this post shows i'm scared, you'd be right. I hate the idea of court, and I've hated this whole process. I can't imagine how difficult and scary this would be without the help of you guys and gals on this forum. It's very much appreciated.0
