    So, BWLegal went ahead. I'm currently at the directions Questionnaire stage. Could somebody clarify a few things?



    Is it too late for NCP/BWL to pull out, i.e am i going to have to have a mediation/court hearing about this case?


    Do I have to send a copy of this to BWlegal, or just to the CCBC?



    Is posting it a safe thing to do? (Of course I'll make a copy to hold on to as well)

    Go back to NEWBIE thread and read post # 2 again, particularly the post by Bargepole and the link about what happens when and by when you must do stuff! He gives a rundown of how to fill in the DQ and KeithP always advises how and where to send the DQ. You've had a post from KeithP - post # 4 in this thread.

    Complete your DQ following the guidance that Le_Kirk has given you.

    When complete, return your DQ to the CCBC in the same manner and to the same email address that you sent your Defence.

    Send a copy to the Claimant - address on your Claim Form.

  • Right next bit of paperwork's come through -


    BwLegal have sent through their response to my defence, in which they've essentially said the grace period doesn't apply - because I've 'Admitted to breaching the terms and conditions as the driver was picking up a passenger' (see post #10 by coupon-mad, I added this to my defence). This was my main concern as my defence does rely quite heavily on grace periods.



    Their response, to me, seems quite strong. HOWEVER at the end of all the waffle etc they've offered a settlement, reducing their price from £24*.** to £18*.**


    What's interesting to me is that surely if they were confident with the case, they wouldnt offer me anything. They certainly wouldn't do it out of kindness lol.



    My options now are;
    1-carry on with the case (which i really don't want to do, being 18 I find the idea of a hearing quite sh*t)
    2-Take the offer (which is still quite a high amount)

    3-Offer to pay the original £60.



    Any advice would be appreciated, cheers.

    1. If it does get to court, treat it as an early life experience. You're not going to be slung in prison or hanged! To be honest (if I remember correctly!), at 18, I was ready to tackle the world. Don't be fazed by the unknown, embrace it and you will come out the other side better for the experience.

    2. That isn't really 'an offer'. To me it is saying we don't have a great case here, and even if we take it to court and win, it will cost us more than we gain. Don't forget, that despite having the veneer created by the employment of just 6 solicitors (of 250 total staff), BWL is primarily a debt collector. You can be pretty sure that your case has not passed under the gaze of any legally qualified person at BWL.

    3. They won't accept it. Don't go offering that or they will immediately smell that you are under duress caused by their harassment, and you'll quickly become the recipient of even more!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Thanks for the advice. Would it help if I typed up their response and posted it on here? That way you can compare it to my current defence. Of course the danger is losing the anonymity of it all, but it's up to you. I'll write to them later politely declining the reduced sum and suggest it is dropped (chances are they won't but its worth a shot hehe)
