HSBC Fake mortgage black mark

On the 17/2/15, I applied for a mortgage in principal with the HSBC, as far as I remember in only my name and as I have since been notified that they do not provide guarantor mortgages, I have no idea how my mother’s name has been linked to this.
I have never taken out a mortgage or any account with the HSBC.

On the 13/2/19 my mother contacted me to say that she had been trying to obtain a small mortgage on a property with her husband. Unfortunately, they were denied and asked the financial advisor what it was that had prevented this as they had a good credit record. The financial adviser told them that my mother had a secured mortgage in my name taken out on 17/2/15.

On the 13/2/19, I called HSBC mortgage department regarding this data breach, I lodged a complaint and asked for any information HSBC held in my name. I requested that my details be deleted from HSBC’s system and my name and the existence of this mortgage removed from my mother’s credit record. I was told that this was probably not possible.
I was told that I would receive a letter within five working days to acknowledge my complaint, I have still not received this letter.

On the 18/2/19 I called HSBC mortgages team again, I was told by the advisor that my complaint had been closed. I re opened the complaint, the advisor told me to contact the data protection team with a subject access request, which I would like this letter to be a request for.
On the 21/2/19 I received a letter stating that a request for information was being processed. I still have received no acknowledgement of my complaint.

One of the advisors that spoke to my mother, mentioned that she had defaulted on a mortgage, in my name with the HSBC. My mother has also never had a mortgage with the HSBC. I believe that somewhere In the HSBC system someone has started a mortgage in mine and my mother’s name.

Under GDPR legislation, I believe that I have a right to know the information that is held on me, I also have the right to be notified that HSBC (whom I have had no contact from prior to this since the mortgage in principle over 4 years ago) have information about me and the right to withdraw this information. I also believe that my name appearing on my mother’s credit record is a breach of my rights.

Now the HSBC have offered £250 compensation the mortgage is still on my mothers credit record (twice). She is still unable to get a mortgage and HSBC have said they cannot find the mortgage.

Does anyone know how I could proceed with this?

    Escalate to FOS if you have exhausted HSBC's complaint process.

    Your mother should make a separate complaint. Best to do that in writing so you have a trail. Ask for the response to be in writing so they can't close it without telling you.
  • Hi Abby, what a nightmare for you and your mum. You should both also write to the three credit reference agencies (Equifax, Experian and Call Credit) asking for corrections to be made to your credit files, enclosing evidence of your comm's with HSBC (if they've offered your mum compensation they're admitting they've made an error!).
    If you haven't already, you might also both like to register with https://www.noddle.co.uk and/or https://www.clearscore.com to get free access to your credit files.
  • Ooh, I forgot to say, a person's credit report WILL show anyone they have a financial connection with and this is quite normal (my husband's name appears on my credit report as a financial connection and mine on his) BUT, of course, the only reason you appear on your mum's credit report (and she, no doubt, appears on yours) is because of this bogus HSBC mortgage so once you've managed to get that expunged, the financial connection should disappear too.     If you're financially linked on her credit report it should show her on yours.

    That product should also appear on your credit report.

    Presumably you have reviewed your reports and found the offending mortgage product, know it's Alleged outstanding value etc and have a reference number for it.

    You say that you believe all of this has been set up. If it has it should be easily accessed on your reports.
