Ticket for parking in own spot!

Hi all,

I received a ticket from Norwich Traffic Control for parking in my allocated space as my permit was not displayed ( I had lent it to my dad who was using it in the van that day -im moving flat).
Obviously it's my own fault for not having the permit at the time but because I own the space does that change anything (i.e. I have documents with ownership of the flat and my car).

Or just pay the £60 fine and move on :/

Thanks for any and all advice :)

Why do you need a permit to park in what appears to be your own spot??
You say you own the space, then what gives parasitic scum the right to use your property to make money for their own aims?

Right, you need to dig out your documents, what do they say about the parking space?

and you have not been fined, if anything you should be claiming against them

  • Spend time reading the NEWBIES it is a mine of information.
Send the BLUE appeal template as advised unaltered.

There are a number of defences regarding parking in your own space compiled by forum experts.

If moving house ensure NTC have your new address - you don’t want to miss any paperwork.
Also update your driving licence and V5C.

Do you rent or own the property and its parking space? If the former, what exactly does your AST say about parking? If the latter, what does your lease say?

As stated, why is some random company operating a business on your property? Why not charge them rent for the pleasure of doing do :-) ?

Why do you need a permit? What does your lease/AST say about displaying a permit? Does it mention a penalty payable tp a third party for failing to do so? If not then they are trying to scam you, there cannot be a contract between you and the PPC because they can offer you nothing that you do not have by virtue of your lease/AST, google "Primacy of Contract, and read this.

    and complain to your MP.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .

    It is NOT a fine.

No-one pays Norwich Traffic Control (joke of a firm on this forum).

See the NEWBIES thread, send the template appeal STATING YOUR NEW ADDRESS AND TELLING THEM TO RECTIFY THE DATA AND ERASE YOUR OLD ADDRESS, then ignore them unless they later try a small claim.

Have you updated the car V5C (NOT just your driving licence) address with the DVLA?

Is this PCN for your old place (moving from) or your new place (moving to)?

  • Thanks everyone for the replies, much appreciated!
For clarification I've just bought said flat (with a standard 110yr lease and a parking space included - I assume for as long as the lease which is managed by orbit housing)
I was hoping that common sense would prevail and if I proved to them that I had the deeds to the flat and also had ownership of the car that it would be revoked however I've heard that the appeals process is far from impartial...
  • And I think NTC must manage the parking spaces on behalf of orbit housing

If you've just bought the flat & have an allocated space, IMMEDIATELY opt your space OUT of the parking scam.

This week, now, and tell the Managing Agents of the site, that you never agreed to it and have primacy of contract and a right to use your allocated bay without harassment by a scammer.

No sleepwalking into a nightmare. Nip this con in the bud, stop agreeing to it.
Obviously it's my own fault for not having the permit at the time
Really? Wow. Obviously not your fault. The only fault is accepting a permit you do not need, that puts you at risk EVERY DAY.

NO OWNER should allow this to be foisted on them, state your case now and opt out and demand that the nasty predatory and punitive PCN is cancelled.
