Britannia Parking Small Claims Court

Received a small claims form today from Britannia Parking 🔔ends saying I owe them £243 apparently from way back in 2015! £85 plus interest and other charges. It's from the Nottingham County Court. First I have heard about anything as they must have been sending letters/demands to my old address. Do I actually stand a chance of contesting a PCN at small claims as don't really want a CCJ for the sake of £250... But they are just crooks and I resent paying them anything - particularly as I have no knowledge of it until receiving the small claims form today.

Any advice would be appreciated. What should my defence be to the small claims court...? Standard letter?

    Hi and welcome.

    What is the Issue Date on your Claim Form?

    Did it perhaps come from the County Court Business Centre in Northampton rather than Nottingham? ;)

    It will likely be Northampton County Court Business Centre not Nottingham. Now go to the NEWBIE section post # 2 and read up on what to do, especially AoS. When you moved did you update your V5C AND your driving licence with DVLA?

    Yes my bad, from Northampton County Court Business Centre - issue date is 26 Feb 2019. Updated drivers licence but not V5C as I sold the car not long after the date they are claiming for so didn't change it. As I haven't received anything up until now, do i respond to the claim and ask them for evidence (photos) or anything else they think they have on me or is it just send a standard defence type letter? Or set fire to their offices? :)

    With a Claim Issue Date of 26th February, you have until Monday 18th March to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Monday 1st April 2019 to file your Defence.

    That's a month away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    send a SAR by email to the Britannia DPO

    login to the gov website and do your AOS online using the MCOL reference

    read post #2 of the NEWBIES FAQ sticky thread, draft your defence and post it below for critique

    Read Post #2 on the NEWBIES thread, but also send off a subject access request to Britannia. There is a Legal Beagles template link in the NEWBIES thread (post 1, from memory). This will show you everything they have about you as a data subject.

    You may also receive it in time for your defence to be submitted if you send it off by email today. Their Data Protection Officer's email will be on their privacy page.

    I don't have a defence - I don't even know if I parked where they say I did, as its 3 years ago! You don't even have to have a ticket in the car park they're on about - there's a sign that says you must give your reg number to the bar. So the car park doesn't even charge a fee, it's for patrons of the pub! So not sure how they can be out of pocket for the few hundred quid they think they can charge me!

    You guys should set up a we handle your PCN for £20 type service!

    Also on the MCOL website there is a box saying: Contest Jurisdiction
    You can choose to contest jurisdiction of the claim made against you... Do I want to do this as I am not based in Northampton?

    There are always defences to be made. Signage, contract, keeper liability...

    No, jurisdiction applies outside of England and Wales.

    When you go through the process, the claim will be allocated to your local county court. You do not have to go to Northampton - the CCBC is just the processing centre.
