Contacting landowner before first appeal

Received pcns from horizon parking for using premier inn east durham car park, first bay after entrance which was empty between hours of 4am to 7:30ish on multiple days. First letter came 7 days after first incident so expecting 7 total. £50 early increasing to £85 each. As I clean car showroom opposite them and local council recently painted double yellows outside of dealership. Have left car in said car park over night after using bar in past with no letters. So though it was ok. No sign at eye lvl on left or right as you enter or leave car park so unaware of new rules. Nothing visible in dark warning of restrictions to parking near bays. Going to take photos before any contact. Only a contact number for hotel no email. What would be best way to approach this over phone or should i just appeal on grounds of poor signage directly to horizon. I would of paid if it was just one as a warning and never parked there again. But 7 in a row with poor signage I think is steep. If I'd known would of parked else where. Any help greatly appreciated.

No sign at all leaving car park taken quick photos last night but need some better ones. Entering sign looks above head height on right side of path. As entering turning left not looking in that direction.0

I would go into the hotel and ask to speak to the manager , explaining that you use the bar frequently , and if they wish for you and your friends to continue using said bar , they should polity but firmly get horizon off your case ASAP.0

And for the appeal, use the template in the NEWBIES thread for all seven, to get a POPLA code for each.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is what i am sending for appeal i have put in my argument will be copying for all four first one is to do today, one tomorrow and two Friday or Saturday
Re PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.
No contract established.
No visible signs especially at night and time of ticket was between 4am and 7am. As no sign at eye level as driving in on left hand side and it's a left turn. No sign at all on exit either side of road. No visible sign adjacent to parking space used (First space just after entrance to car park). If signs were properly placed alleged offence would not of taken place. But no contract has been established between yourselves and vehicle in question due to inadequate signs. I have photos from drivers point of view. If it had been a windscreen ticket this would not of happened multiple times would of paid first one and chalked it up as mistake. Which strengthens my argument that signs are inadequate. You would not park somewhere four times in a row after reading parking signs
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:
- If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
- If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.
- in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.
Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.
Yours faithfully0 -
Don't add stuff like this, saying that you'd have paid it (NO YOU WOULD NOT) particularly not 'would of/could of' bad English which weakens it straight away:If it had been a windscreen ticket this would not of happened multiple times would of paid first one and chalked it up as mistake. Which strengthens my argument that signs are inadequate. You would not park somewhere four times in a row after reading parking signs
Stop trying to change the template appeal. Just use it as is, and if it wasn't pay & display then you can of course remove the phrases about that, obviously.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I appealed all with no changes to template. Removed payment machine paragraphs. Received overdue letter for 3rd pcn. I appealed them in order. Could this be scare tactics as they say £10 will be added if after 28days. After which it will be passed to our bebt recovery agent which may escalate to court proceedings.
Should I appeal with template again but in ref say already appealed on 23rd March? Thanks in advance0 -
Ignore reminders. If you appealed already, they have 35 days or more to respond.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Did you complain to Premier Inn?
Do staff there know you quite well? They might put in a good word.
I'd word a complaint email carefully. I can't quite work out how parking overnight helps, but you know the circumstances and how it all works, so explain as long as it sounds 'good'!0 -
Spoke to manager wasn't interested said take it up with company. The area parked in has no visible signs close enough to parking space used in night conditions. But guess all of this kind of info is used at next stage. Since manager wasn't interested.0
