  • Your Witness Statement is to tell the story, and shouldn't add in any new defence points that you may wish to rely on. Obviously I'm not sure that is the case with you, but worth noting anyway.

    So do you think my defence is poor?
  • You haven't given any of the details of the actual case to make much in the way of comment yet.

    If you were relying on keeper liability, there is no mention of POFA. The loss argument is old and null. No real mention of the offer and acceptance of a contract. Plus the ANPR issues The Deep mentioned above haven't really been capitalised.

    But simple fact is I have the payment ticket so I can prove I paid for parking, would a judge penalise me for this knowing of the scam tactics they use.

    Maybe yes, maybe no. Which is your nearest court? Some are good.
    Their own ANPR records show that there was no vehicle
    on site with the VRN I accidentally keyed in and as evidence, I was able to produce the ticket as proof that I paid but made an inadvertent error with the VRN,
    The above is your basis of defence but I couldn't see if your defence mentioned the wordy signs and the fact that the PDT ticket has Excel's name on it, so the contract at the machine was only with Excel, not VCS.

    Have you got that buried in there?

    Proving that you paid is the important part. I charge would not penalise for that.

    More so, what a judge would be interested in is what happened to the money you paid ???
