Ebay and DRS Debt collectors

hi all, just wanted some advice, i sold my iphone 7 about six months ago on ebay for £212.00.
I sent it through their hermes shuttl service at the nearest shop that printed their labels. they received it but "lost" it at their warehouse. long story short i got paid withdrew the money, ebay paid the customer back as i wouldnt and now they have got DRS ardent chasing me for the money.
i dont want to pay as its not my fault and hermes, ebay and shuttl blame each other and say the max compensation is £20.
but will it affect my credit rating now the debt collectors are involved etc?
or will i need to accept that they are holding me responsible and pay the money back.

    I'm sorry to break the bad news, but it "is" your fault as you chose to use a postal service with a compensation value which did not adequately cover the value of the package you were sending. :(

    It is a gamble whenever you use a cheaper "under-insured" postage service to save a few quid. If your items arrive OK you can regularly win small, but if something valuable disappears you can sometimes lose big.

    Whilst this is 'your fault' as a seller it cannot impact your credit rating unless you get a CCJ against you- and ebay is not noted for actually going to court.

    However you have of course lost the ability to ever use ebay or paypal again, and anyone that ebay consider associated to you may also struggle . I would go as far as saying that if you do share a home with anyone or have used your computer on someone elses wi fi warn them that they shouldn't be keeping large balances in paypal in case paypal freeze it against your debt.

    I would recommend you try one of the debt free boards here on MSE and ask specifically about the powers that the debt collector has- and make sure they don't overstep the mark. Be prepared for a fair bit of aggravation but know in advance the limit on how far they can go so you are prepared.

    If the matter is taken to small claims, if you lose and then don't pay within the time allowed by the court you will end up with a CCJ but until then, as far as I know, it won't affect your credit rating.

    If you do lose some costs are likely to be awarded against you, minimal but maybe another £75 for court process fees plus a small amount for the other party covering things such as travel. Companies can't claim big legal fees in small claims cases.

    If it did go to court it's extremely likely that you would not win as the responsibility is placed upon yourself to get the goods to the buyer.

    If you have issue with Hermes or Shutl you'd need to make your own claim with them.

    If you want to pay I'd phone eBay and see if they accept payment for the original amount due to close the matter.

    Whatever happens it's very unlikely you'll be able to use eBay again.

  • I learned the hard way that you never under insure an item with hermes. One of my most expensive items I ever sold went missing with hermes, the cheap items never have any issues arriving.

    I think it is good practice to not under insure goods regardless of which courier you use. The only time I'd ignore that is if seller 'self insures' ie covers their own losses as many of us do on borderline cost.

  • i assumed it was insured through ebay as i chose their own delivery service and paid for it, i have tried to argue the toss with them and hermes but to no avail, looks like il be paying it back.

    To be fair when you buy via shutl it couldn't be clearer what insurance is included. It says the insured value by the postage costs, each option shows the various standard insurance . Also below the options on the same page in a huge box it shows the cost of upgrading the insurance to cover the full sale value.

    It isn't hidden nor is it difficult to see, it is right there on the same page and shows when you get the various options.

    If they lost it, they are negligent, no defence for that, so it's their problem, not yours.
    They know they lost it but it's still the op's problem as it's under insured.

    It's true they won't go to court, it's also true though that they will lose their account's with Ebay and Paypal along with anyone at the same address. So if they can live with that then sure, just ignore everything.
