Gladstone Solicitors County Court Letter

Hi everyone,

The situation: Last year in May 2018 the driver A of the car breached the terms of parking somewhere and got a PCN by Euro Car Parks. Shortly before Driver A received the PCN by post she sold her car to Driver B and moved abroad. That being said Driver A at the time lived at the same address as Driver B so the PCN came to Driver B's current address but addressed to driver A.

Driver B has been throwing the euro cark parks PCN's in the bin since they where not in his name. Last week I received a letter with the claimant as Euro Car Parks with the County Court Business Centre stamp and address on it as well as a claim number including amount claimed, court fee and legal rep fees totalling up to £243.85. When I googled the County Court Business Center I found out that unlike other County Court centres the CCBC does not physically hear cases.

Advice: Has anyone dealt with such a claim before and the CCBC?? What course of action does driver B take in this case. The issue is that although Driver A who the PCN is being addressed to doesnt reside in the UK she still visits the UK twice a year and has some of her bank statements coming to my address. Could that affect her in any way or form when she arrives in the UK next?

    Have you read the stickies/FAQs, they deal with PCNs sent to drivers living abroad.
    You never know how far you can go until you go too far.

    Short answer is yes, if she doesn't respond or do anything about this, then she could end up with a default CCJ.

    The CCBC is a processing centre for the courts. When the claim is progressed, it is allocated to the defendant's local court. This is a real court claim, so not ignore it.

  • I dont have any contact with Driver A at the moment. All I know is that she lives in Turkey now so shall I call Gladstone and tell them she is residing abroad?

    Tell the court she has moved abroad. Can you get an address for the driver? If you can give the court an address it will be helpful.
  • 1) In whose name has the Claim been filed against?
    You managed to not say it at any point
    2) Calling gladstones is pointless. NE VER call.

    3) If the KEEPER (not driver, KEEPER) "driver A" has permanently moved abroad, then they will nto care about a UK CCJ

    YOU have no standing in this claim. YOU cannot do anything. If you have no way of contacting the original keeper to even tell them of the Claim Form, so they can contest jurisidction properly - which will cost £100 as they have to Apply to the court - then what do you expect to be able to do?

  • The claim is under the name of Driver A who was the keeper at the time of the contravention. The only method of contact I have with her is her phone number in Turkey. I have sent an email to Euro Parking Services explaining the whole situation and I told them that the only method of contact I have with Driver A is her mobile number it Turkey. Shall I contact the court and explain the situation to them and provide them with her mobile number?
  • Driver A is a very old retired lady so I doubt she will be able to pay the court charges unless Euro Parking services cancels the claim. The issues is that she visits the UK on Xmas and Easter holidays every year so I'm worried she might be stopped upon her arrival for a CCJ.

    This is just a civil matter and not criminal.
