It was at Kingston County Court - I'm afraid I can't remember the name of the judge!
I had sent off my Witness Statement to the court (via email) beforehand. I arrived about 40 minutes before the start time - went through security (all very friendly) and was pointed towards the usher on the first floor to register that I was there.
I have to stress that everyone I dealt with was very friendly and accommodating. I registered, and confirmed that I was defending myself. Gladstones hadn't bothered to send anyone despite appearing to have about 5 cases in that court alone that day for UKPCM.
I then sat and waited in the waiting area - lots of activity of different people going into different courts, some with solicitors, some without.
Miraculously they were running to time so my case was called and I was led through to a small hearing room. It's not an intimidating place by any means - the judge is sat a desk thats the width of the room, and in front of it is another desk with two seats with a small raised barrier between them and the judge.
She had my WS in front of her. I had prepared a ring binder with tabs for where all the evidence was located etc and a copy for myself just in case for whatever reason they had lost the copy I had emailed.
The Judge was very friendly, but certainly highly professional and direct. After I sat down (and she'd enquired if I was a lawyer representing myself as my WS was so good - (thanks again everyone!) she pretty much moved straight to judgement in my favour. She read for the tape (the hearing was recorded) her reading of the Jopson vs Homeguard case - asked me if I knew it was still current - which I confirmed it was, and directly read out the judges words in that case defining stopping vs parking.
She asked me to confirm that I had spoken to my wife to confirm that the stop was a minute of less, which I did. She then went on to specifically cite the evidence of their changing their signs afterwards as an acknowledgement by UKPCM that they had not covered stopping.
Finally she cited the grace period anyone should have to actually read the signs which my wife wasn't given.
At that point she formally ruled in my favour. She then moved straight to awarding me costs (I didn't have to ask) using the cost statement I had supplied. The costs I asked were way too high! She didn't mind that however, and awarded me my travel costs and the maximum allowed for a day (£95), informing me that UKPCM had 14 days to pay me.
At that point it was over bar a brief chat about what I did for a living (not a lawyer) and out I went. All over in less than 20 minutes.
I have a pretty stressful job where I go into a lot of high pressure situations and even I was nervous before I went in never having been to court before. But I can definitely confirm that everyone is there to help you and to get to the right judgement.0 -
