Yes, you'd be copying a recent defence talking about forbidding signs, as (even without the stickers they have added) the Claimant's intention was to create a no stopping area.

Thus they cannot then say that they offered you a licence to do what the signs expressly say you can't do.

And in any case you were presumably there minutes only? Grace period applies.

To find relevant defences, search this forum for defence grace period Bull true

    one minute =

the PCN contravenes the CoP as regards:

    - the mandatory grace period, and

    - prohibition on predatory ticketing/lurking like this:

Thanks for this - this is brilliant. One last check - I have an unbelievably hectic schedule. Not that I want to do this - but if the court date proves impossible I assume I can duck out at any time by simply paying the damn fine to gladstones?

As I have ignored every letter sent, never corresponded with UK CPM at any point - how can they claim I ever agreed to pay and then didn't?

They allege that, by parking you contractually agree to their T&Cs.

Are you a resident? If so, have you read this?https://parking-prankster.blogspot.com/2016/11/residential-parking.html

What does your lease/AST say about parking?
You never know how far you can go until you go too far.

    OP says this in #6

On the defence side - is that there was no warning given to users of the site like us (who didn't live on it) that there was due to be "enforcement" put in that there should have been a grace period etc etc?

I must admit I am struggling to see how such a warning would be given to non residents using a residential site.

Thanks All - any answer to my being able to "back out" and just pay the thing if I can't make the court date?

Why on earth would you do that, when you can simply write to the court and absent yourself and ask that the case is decided on the papers?

Have you sent your DQ back to the court? On there is a chance to input dates when you will not be available.
