I have read the newbies thread and multiple threads from others. I am looking to email CPPlus using the resolver app and clicking on other reason, I have copied and pasted the template email and added some more additional information, omitting the fact of who was driving as advised. This is a draft email , looking for feedback before I send it on to them, any advice or helpful comments would be welcomed, I am a first time poster.
Dear Customer Services
We are contacting you because we have an issue that we would like to raise. This relates to: MOTO Frankley Services South Private Car Park.
Our issue relates to a recent journey 12 February 2019, on which we were feeling rather weary after a long night, we finished work and set out on our journey and became rather tired, it was dark and so we decided to pull into your services for a rest break, we literally followed the road markings saying cars this way and did not notice any signage whatsoever, we pulled straight into a parking bay and fell asleep, once we awoke we set straight off on our journey once again, not even aware of how long we had been there or of any parking charges, believing that it was the correct thing to do to take a break for safety reasons and that there would not be a charge for stopping for such a break as it was a service station and the ideal and only place to take such a break on a motorway.
The Notice Ref Number we have received is:
*************
In it it says we arrived at 05.33am and left at 07.56am in the picture you can clearly see our headlights on as it was dark.
We dispute your 'parking charge', and as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:
- If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
- If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.
- in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.
Formal note:
Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.
Yours faithfully,
THE NAME AND POSTAL ADDRESS OF THE KEEPER

You've read the Newbies thread but want to alter the template that says don't alter it? You also want to use the absolutely useless resolver app?
Can I strongly suggest you read the Newbies thread properly and send the template unaltered. CP Plus often cancel on receiving the template.0 -
Don't forget to write to Moto too, and your local MP. There have been a few cases about being too tired to drive safely on here recently - have a read through (using the advanced search, looking in this board only) and see what happened with them.Natwest OD - Start: £1,500 Current: £1,500 | Creation Loan - Start: £2,152.33 Current: £2,082.90 | Barclaycard CC - Start: £5,242.42 Current: £5,416.45 | Novuna Loan - Start: £8,598.43 Current: £8,366.04 | Tesco CC - Start: £9,420.22 Current: £9,885 | Northridge Car - Start: £15,584 Current: £15,017

Oh don't use useless Resolver for parking charges!
Just submit the forum template appeal from the NEWBIES thread.
There is a reason - CP Plus recognise it and will fold.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

One final question before I email original template, the charge notice I have received mentions ParkingEye V Beavis, has a photo of me entering and leaving car park and has a printed picture of a sign (not actual photo) and mentions they are a member of BPA. Am I best emailing the address on back of charge notice or find email for BPA directly and is this wording below still the current template, really appreciate your help, I’m new to this, thanks 😊

THE NAME AND POSTAL ADDRESS OF THE KEEPER (OR THE HIRER/LESSEE) GOES HERE.
THE DRIVER IS NOT IDENTIFIED.
DO NOT PUT YOUR NAME HERE INSTEAD, IF YOU ARE NOT THE KEEPER/HIRER/LESSEE. YOU ARE NOT HELPING IF YOU DO THIS WRONG BY APPEALING IN THE WRONG NAME!0 -
Send it to the address on the NTK. The BPA are merely their trade body and don't hear appeals.0

Are CPPlus upping their game
Answer = NO.
Obviously you appeal using the contact they allow, on the PCN...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I’m currently online to appealpcn.co etc (CPPlus), once you enter your ref number and registration it gives you only two options (tick boxes) before you continue:-
(Baring in mind all advice says don’t declare who the driver was, if I was the driver and I tick option 2, will this not cause me problems later).
o Tick here to confirm you were the driver and that the PCN you have received contains the correct information
o Tick here to confirm that you were not the driver or that the PCN you have received contains incorrect information0 -
tick the one that says the pcn has incorrect information then0
-
Just out of interest was your NTK from a company called DRP? That looks like the work of DRP.0
