Help! CCJ of £350 from CEL = COWBOYS :(

Hi,

I have done some reading on these threads as each case is little different wondering if someone can help with setting aside my CCJ from the cowboys that is CEL!

I had a company car which I got in July 2014 then purchased my house and moved in Aug 2014. I sent a letter to work HR to confirm my new address sent on Oct 2014 via email.

Fast forward to Nov 2018 credit check shows a CCJ for £352 Judgement date 29/6/2017 - I called the county bulk centre for more details. I was told claimant to be CEL when they looked into the form online they said it gave no details to offence location potential date of fine I think it gave a date of 26/2/2016 as no major details the person was unsure. I asked for this to be emailed to me but it was not sent I will call again to get a copy. I don’t believe it give me anything to my defence as it say nothing to what the £352 fine is for or maybe for that reason it does.

I called my lease company to see who had requested my information. little more information Fine date was 26/2/2016 fine type parking and company was civil enforcement.

Address given by lease company was my old 2014 address. I emailed to ask who should have provided them with an update of address HR or myself and they confirmed HR should notify them of any change in address. As i have my email sent to HR oct 14 I assume this can go in my fav in my defence.

2014 was on elect-roll for new address and 2015 my driving licence had new address on it.

side note lease company said I got an parking Junction box fine from a council info sent to wrong address again but I believe I paid this not sure how they got hold of me DLVA maybe? should the CEL gone to DVLA as well? my driving license and even electro roll was all pointing to right address … can access this information? they also could have gone back to lease to say no response from client but maybe they don’t have too. Feeling is if they wanted to locate me even company and lease didn’t have right address I don’t believe i was hard to find!

Recap:
CCJ is still active - I want set aside - I want them to pay for it - I want to write a solid defence.

Concerns I contacted Bulk in nov 2018 and now only dealing with this CJJ delay on my part as y wife had give birth and then well everything goes out the window :eek::eek::eek:

I see very similar case in Saggi1975 thread would like to copy and paste that and change few details based on the information above and any advise you can give me.

    The NEWBIES FAQ sticky, post #2 has a specific section dealing with CCJ set asides. Follow that.

    Standard fare for CEL. A case of court papers going to a former address, with you blissfully unaware of their issue, is a virtually guaranteed set aside. But the chances of recovering the £255 you will have to pay for that are slim, if CEL has but corresponded with the address provided to them by the DVLA at the time of the parking event.

    made me question my DLVA information! issue date 15/3/2016 vs fine date of 26/2/2016. Chances our during that fine I was in process of changing my address. However as I moved in 2014 am guessing they would question why such a long delay I have no answer for that lol. Thanks for your reply I will follow the search you have stated above.

    CEL are simply wild animals who should be culled

    The only way CEL win is when you don't know what is happening

    CEL are members of the BPA who claim they are putting up standards ..... As one MP has said, the BPA are as useless as a car park in the Gobi desert

    So, sorry the government dictates you pay £225 to get this set aside.

    We do.

    People tell the Judge that they thought by updating their driving licence address with the DVLA (which I am sure you did sooner?) that it would be cross reference to also change the address on other DVLA records.

    Isn't this about a company car? DVLA would point CEL at the company for whom you worked or the leasing company if the car was not owned outright by your company. If you told your company's HR that you had moved, they would presumably have given your correct address to CEL. Therefore I think you have a good case for a set-aside.
  • OP and C-M - this is a COMPANY car, so the OPs never going to be changing the registered keeper address, it would go
    Leasing company -> company OP is employee of -> HR of OP company gives OP address as actual keeper

    What noones picked up on is that the OP has probably screwed this, by waiting so long
    They foudn out about the CCJ in November 2018 and have therefore not acted promptly

    This will need a good explanation - the pregnancy and giving birth SHOULD help, as judges are human, but it will need a grovelling apology first.

    So to confirm the CEL wouldn't have gone got my details from the DLVA anyway? as car would point to Arval - CEL contact them I know that (but I dont know the date they contacted, i will find out) got my details from them But as HR didnt update company they pointed them to wrong way..

    if so is it even worth mentioning that DLVA at time was being updated with the right address

    Also reading other threads I saw about going after RG keepers, yet I assume am not the RG keeper or am i? I assume its the lease.

    Reason I say this ... can CEL really come after me? they have provided no information on - location - time or who was driving. I am thinking of building my defence around this and HR not updating the leasing company of my details.
