Hi Folks
Just looking for some advice Have received a PCN as the registered keeper for £100 from Civil Enforcement for an over stay of 27 minutes on a 2 hours limited car park. I have read the sticky post regarding PCN and notice that the Advice in Scotland is always to appeal to the landowner or Store Manager in the first instance. I am in the process of trying to find out who the owner of the car park is, its a retail park and the largest store being B&Q any advice on how to track down who is responsible for the car park should I try local council?

A - IF THE EVENT TOOK PLACE IN SCOTLAND OR NI, WE SUGGEST YOU DO (ALWAYS!) COMPLAIN TO STORE MANAGEMENT IF YOUR PCN IS FROM A RETAIL PARK, BUT DO NOT APPEAL, UNLESS YOUR CAR IS A COMPANY/HIRE/LEASED VEHICLE, IN WHICH CASE, APPEAL AS HIRER/LESSEE (SEE * AT THE FOOT OF THIS POST).
IN SCOTLAND/NI, CERTAINLY COMPLAIN TO THE RETAILERS, BUT IGNORE THE PARKING FIRM UNLESS YOU GET A CLAIM.
IN SCOTLAND THIS IS EXCEEDINGLY RARE, AND DEFENDABLE BY A KEEPER, WHO CURRENTLY HAS A FAR MORE PROTECTED POSITION IN LAW THAN AN ADMITTED DRIVER.
WHEN IGNORING IN SCOTLAND/NI, KEEP ALL LETTERS. DO NOT THROW THEM AWAY, FOR 5 YEARS"

Local council and ask who pays the non-domestic rates (or whatever rates are called in Scotland).0

Alternatively ask one of the retailers. If you spent money in one of the stores they may well have the power to cancel it.0

Any advice on how I word the appeal to the land owner without advising who the driver was on the day?

As registered keeper of a car visiting your shop/cinema/pub/restaurant I have received a PCN ..........
If it costs an additional £100 every time someone shops/eats/visits, we will have to consider going elsewhere!0 -

Which bit of "Scotland = IGNORE the scumcos" is difficult for people to understand???0

Surely if you just blindly ignore all it’s gonna result in is endless threatening letters and the prospect of a CCJ no one has broken down the reasoning why it’s different for Scotland other than it’s rare for them to pursue it. I would prefer to get it sorted especially seeing as the signage in the car park is really inadequate0

I am not telling you to ignore the clear advice to ALWAYS complain to the retailer. I am telling you to stop thinking that it is 'an appeal'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

At the top of this board is a thread that tells Newbies to read it first. There is a section on what to do in Scotland and why things are different up there. Hint Not all English law applies in Scotland.0
