As for the plumber's case, get him to put you down as a witness (so he needs to put 2 witnesses - himself, and you, on his DQ) and then make sure he doesn't overlook WS & evidence stage, as some people do when they get the hearing date they think they can just turn up having submitted nothing since the defence.
He needs to put Jopson v Home Guard in as an exhibit with his & your WS.
If you can attend his hearing as witness it will help him, as you won your case and can reiterate the position.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks The Deep - unfortunately I did not apply for unreasonable behaviour costs but after this court case for my plumber I think I will as my car receives about a ticket a week despite me winning the previous case.
In terms of the court proceedings it took about 5 minutes as the judge led the way and if I recall correctly asked me no questions barring my name perhaps. He said that my defence/WS made clear that the 'parking enforcement company' were not a party to the lease and wondered why they thought they could issue me a ticket. Their solicitor stated that they sent out a letter stating that they had been instructed by the landlord/managing agent to do so on the development. The judge then asked him whether I had agreed to that in writing and he said no. So the judge finally asked whether he could explain why this claim had come to court to which he responded with a sideways nod ashamedly. And that was that!0 -

I called last week and was told over the phone that on the date after they should have submitted fees that they had not done so. I was further told that it might be an idea to await a 'struck out' notice but instead have only received the claimants WS. Is it possible for the case to go ahead or likely that it has now been struck out? I am trying and failing to get through to the court since.0 -

Apologies if this has been asked before but as this case relates to my plumber how does he do the Witness Statement?
Am In included in his WS or do I do an entirely separate one as I have received no instruction from the court or otherwise?
Also - is it in his WS that the appendices are included or mine or both?0 -
If this is his case, then he does his WS as usual with any evidence appended to that, and a costs schedule to claim his costs, and he should refer to your case that was thrown out already based on the same facts of the lease and say that he is attaching a WS from you.
Then you write your story on a WS for his case.
Tell him to include Costs Schedule to get his costs and a copy of your lease/agreement, and the Judgment or Order where the Judge sent you a one-liner after your hearing, saying that you won and the C was ordered to pay £xx costs to you.
Also tell him to do a SUPPLEMENTARY WS (copy one) about the added £60.

have you considered sending the scammer a "cease and sesit" letter"? That way if the offend again you can reaaly give the a kicking.
BTW, there is nothing to stop you seeking your costs directly from the scammer.

Once I get this case out of the way I have every intention of going after them. They ticket me far too regularly and my sister made the mistake of paying some of earlier claims they made through the courts whilst I was overseas. I'm hoping I can recover those somehow and make them pay damages for continuing to ticket me despite the most recent case being awarded in my favour.
Which method I should use to do both would be great to receive guidance on..0
