    Presumably you will send back the one to the court by e-mail, meaning you will still have it! Send that to other parties by e-mail and you will still have it! Unless, of, course, you printed it, filled it in and sent it by post.

    Didn't realise I could send it via email as the covering letter doesn't mention it, just says DQ needs to be filed with the CCBC and gives their address.

    Although, I have just found another post on here asking the same question....so I will go and study that

    Yes, return your completed DQ to the CCBC in the same manner and to the same email address that you sent your Defence.
    Refresh your memory by re-reading post #6 above.

    Send a copy to the Claimant - address on your Claim Form.

    I have received a letter from my local County Court with a date of the hearing. I have prepared a witness statement to send to the Court and claimant. Should I include a list of my costs as well? I see from the Newbies thread I need to serve the list of costs 24 hours before the hearing so should I just send this in with the Witness statement to the court?

    yes you can do so if you wish to, add any other evidence at the same time


    ideally email these things to the claimant , but print and use a ring binder etc for the court, because a court may not print everything that you email, hence why you follow the details in other threads plus post #2 of that NEWBIES thread. CM repeats this info numerous times too

    The 21 days before the case is heard in Court is up, and I still waiting for the Claimant's WS (should have arrived by Friday). So only three weeks to go, I want to make sure I have everything prepared for when I sit before the Judge. I have printed my Witness Statement, Directions Questionnaire etc and will put them in a ring binder and annotate.

    When I receive the WS from the claimant, can I highlight pertinent points in their statement that I disagree with so I can refer to it if necessary? Also should I bring up that their WS was late in arriving ( I am assuming their WS is on its way to me)

    Is there anything else I should include or take with me? (I understand that I cannot rely on any evidence that I didn't put in my WS, so shouldn't include anything else in the folder)

    This has been going on for nearly two years now, so I am almost looking forward to it just for the experience.

    With regards to what is being claimed (£252 made up of £177.90 claim, court fee £25, Legal Rep costs £50) I have read some threads where the amount has been reduced when the defendant loses the case. What is the likelihood of full costs being awarded?

    Yes and yes.

    Your wage slip or proof of your loss of salary/leave for attending, plus proof that you emailed your WS & evidence to the other side and when as their reps sometimes like & tell the Judge the Claimant never received this. So you need a printout of that email.

    And a copy of your costs schedule, that you must also file & serve to court/claimant 48 hours before the hearing.

    I assume you presented your WS & evidence in person to the court this week?

    Yes, I hand delivered the WS and evidence in person to the court on Friday , but had also emailed it on 30th April to the court and claimant.

    I have just received a letter from the court “General Form of Judgement or Order” stating that the claimant has failed to file any evidence in persuance of the order and has been given 7 days to comply. Otherwise it will be struck out.

    Am I advised if the case is struck out before the hearing? It is next Friday so the claimant has until 2 days before the hearing to send evidence to the court. I obviously want to claim costs if it is struck out so assume I should go to Court anyway and give my details of costs?

    Seems odd that the claimant has failed to send evidence 12 days (and counting) after the deadline
