I sent them a reply using the standard template and did not disclose the driver. I received another letter today from TNC Parking Services headed "Notice of intention to advise client to issue summons" and the fine has increased to £160 due to "admin charge"

"Please be advised that unless settlement of the above Parking Charge Notice is received by this office within 7 days of post mark heron we intend to advise our above client (CPS Midlands) to instigate immediate legal proceedings against you"

They also made reference to a case in Scotland on 13th January 2017 where an operator took a motorist to court and won, the had to pay £24,500 :rotfl:

I do not intend to reply to the letter.

doesnt say anything about a "summons" , you made that part up

this is a civil matter , so any court papers would be the MCOL system , from the CCBC inNorthampton , nothing to do with that scottish claim against a known driver

a summons is for a criminal offence , which this isnt

Redx, I have nothing to gain from making things up. I am just reporting the facts that are taking place regarding the harassment from CPS and TNC.

I believe this is just threatening behaviour. If they are using inappropriate language and terms then even more reason to complain to my MP?

    thanks

if it really says that posted in your link , then yes you should complain

    https://ibb.co/nCzGTGR

I can assure you that it is an incorrect legal term and should not be used , so complain to your MP , plus to anyone else that is suitable

a "summons" is not issued to people for private court claims

Why did you make that broken link so difficult to reconstruct?

    http s://ibb.co/nCzGTGR is equally 'broken'.

The forum wouldn't let me post a link as I'm a newbie and they block links to websites to prevent spam. Sorry, it was the only way I could think of uploading it!

Yes, completely ridiculous that they use language like that. I'm going to collect all the letters and then complain in one go.

    thanks

The point that I was making is that you only needed to insert one blank in the url rather than a blank after every letter.

Still, keep replying and you'll soon have enough posts to be able to post live links. :D

TNC are members of the BPA, but they are acting on behalf of an IPC Operator (TNC have no IPC approval - as far as I can see).

If you’re up for querying their right to operate for an IPC Operator while being a member only of the BPA, ask some very tricky questions of the BPA.

The more you kick up a fuss, the nearer you get to them seeing you not as low hanging fruit to pick off at will. Go for it - as many awkward questions as you can muster - starting with ‘Summons’!

Write to Steve Clark of the BPA, who strikes me as a decent human being who will help where he can (notwithstanding who pays his salary).

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Make a complaint to your local Trading Standards Office that, by using the word "summons" they are attempting to obtain money by misrepresentation.
