Parking Charge notice now a Northampton County Court Business centre claim form

In August 2018 I parked in a private carpark managed by UKPC, I paid for a ticket however was 9 minuets late back to my car. I had no yellow ticket on my car when i returned however they clocked me using anpr cameras on entry/exit. I later recived a PCN (parking charge notice) in the post. I have ignored all letters as I only respond and pay to Penalty Charge notices issued by the council or law enforcment. I believe the pcn has been passed onto a 3rd party debt collector. I have ignored all letters and not acknowledged anything at any time. However today i recived a shady looking claim letter from Northampton County court Business Centre. I have looked online and they look legit as It is an official Gov website, although people are advising to ignore the letter some people claim they did this however now have a CCJ. One person says he had his car seized. It states I have 14 days respond. What do i do? What is your advice? I dont want to give the company any money or staifaction. I know they are scammers but they are serious to get the money from me. They only have my name, address and registration. They do not know I was the actual driver at the time. I no longer own the vehicle. Please help on what I should do and how I defend my self to prevent me from paying or having a ccj. Thank you in advance.

    What is the Issue Date on the Claim Form?


    You now need to edit you post above to remove clues to the driver's identity.

    The parking companies trawl this forum and can try and use your posts against you.

  • If it's from Northampton CCBC, it is a legitimate claim process.

    Have you had a chance to read through the NEWBIES thread? Specifically Post #2? This is the post that covers exactly what you need to do and by when. You need to do your Acknowledgement of Service ("AoS") if you haven't done so already.

    While you're at it, submit a Subject Access Request to UKPC. There is a Legal Beagles template in the NEWBIES thread which you will need to send off to their DPO.

    And you would also want to look up BPA grace periods

    this should have been appealed right from day one when the NTK arrived in the post

    do not ignore any PCN from a private parking company in future, unless you have deep pockets

    as above , read the BPA CoP on grace periods as 9 minutes is well within limits and would have been an easy win at popla, months ago now, but too late for that due to you being in IGNORE mode

    the court claim letter is genuine and only a complete fool would ignore it

    With a Claim Issue Date of 22nd February, you have until Wednesday 13th March to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Wednesday 27th March 2019 to file your Defence.

    That's over a month away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    these private companies have 6 YEARS to take them to civil court, so only the ones BEFORE march 2013 have "timed out" - so not clever at all , eh ?

  • As a slight cautionary tale, I had a default CCJ against me for a PCN in 2015 (currently going through the set aside process). There is also one from 2014, which as just surfaced at the debt collection stage, and I strongly suspect will turn in to a claim (that one, i had zero idea about until very recently). So yeah, ignore by all means, but expect it to come back with teeth.

    Don't forget to do the SAR - with 30 days in which to respond, you should receive the information before your defence needs submitting, and may be helpful to you (but certainly will be at witness statement stage).

    When you're ready, post your PoC and defence up for comment.
