    Hi people,

    So I was wondering whether I needed to follow up if the CC received my directions questionnaire.. I sent it via 1st class but not recorded or anything.

    Also I received back my SAR request back today... doesn’t seem like they have anything strong. They just sent me a copy of my NTK basically, no photographic evidence and of course didn’t identify the driver.

    My bad, they did actually have photographic evidence. I couldn’t open everything through my phone. They have every bit of correspondence on the SAR, including LBC, NTK and photographic evidence of the vehicle in the car park along with photos of the signage.

    DO NOT USE A PHONE FOR THIS TASK

    ideally, use a laptop , because a laptop allows you to "see" everything and you can do much more with it (or use a desktop pc or tower pc)

    you should be able to login online to check the status of the MCOL claim . although the DQ could have been emailed to the CCBC to their email address, same as a defence

    nobody here can tell you the status , only the CCBC , to you and you alone

    you need to go through the SAR reply and look for anything that supports your defence, the idea is that you get to see that evidence now , instead of seeing it just before the court hearing, this helps you to draft your WS and EXHIBITS in time for that future stage

    No idea why anyone would use a phone for any stage of this process!

    Your DQ will show as being received, when you log into MCOL. You should have emailed it though, not posted it to the MASSIVE building (black hole) that includes the CCBC.

    Am I right by saying you need to submit your witness statement at least 14 days before your court hearing date?

    That is often the case, but you will have received a Notice from the court advising you when "Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than...".

    Ok great. So I’m in the process now of building up my witness statement.

    Just wondering do you guys have any links to witness statements for the VCS ‘this is not a parking charge’ defence or similar? Couldn’t seem to see a witness statement for the relevant case on the sticky thread to have a look through.

    Also as well as the above should I target the fact that they haven’t established the driver yet in my witness statement + I have no obligation to name the driver etc?

    There is no compulsion to name the driver, or law

    Yes identify pofa failure and expand on it

    We have dozens of VCS threads and court cases on the go here, some are at ws stage, find and read their account and use it to form your own personal ws

    Just received witness statement documents through post today from claimant, seems like they’ve attacked every point of my defence and appointed a paralegal who just started working July 2019 lol :-). Guessing he/she are a special just for me
