FABB SOFAS FAULTY SOFAS
Advice needed please
On 23.05.17 We Purchased a leather 3 piece suite from Fabb sofas a 3 seater recliner a 2 seater recliner and a chair recliner which cost £4500 in total we took finance out on these with hitachi personal finance through fabb sofas .
On the 12 Nov 18 we noticed that the leather had started to peel away in several places on the suite and one of the seats on the 3 seater had collapsed plus a USB port had stopped working so I decided to call Fabb sofas but to my surprise found out that they had gone into administration on 7th June 2018.
So I then contacted hitachi personal finance and explained what the problem was and they got a company called homeserve to arrange to come out and take a look at the sofas and do report .
Homeserve came to my home on the 28th Nov 18 and done the report and said it was a manufacturer fault in the pigment in the sofa which was causing the leather to peel away and bad craftsmanship in the structure work of the sofa causing the seat to collapse on the 3 seater they said they would be able to recolour these parts of the sofa and fix the usb and the collapsed seat so I agreed to have the work carried out by homeserve .
They came back on 19th Dec 2018 to do the repairs but when homeserves technician turned up he said he was only here to recolour the parts that had peeled away and he knew nothing about any other repairs so I immediately I got in contact with hitachi personal finance who then contacted homeserve whilst the technician was in my living room recolouring the parts of the sofas .
They then came back and said they had lost the report about the usb and the collapsed seat and asked there technician to do a full report on it again after he had finished recolouring which he did he also said that he was pretty sure that the recolour will not last as the pigment in the sofas is faulty and won’t hold the repair .
A week later i noticed that the leather started fading and peeling away were he had recoloured it and also other places of the sofa .
So I contact hitachi personal finance again and they arrange for homeserve to do another report when they come next to do the other repairs ie the usb and the collapsed seat on the 3 seater .
On the 25th jan 2019
The same technician comes to my home to carry out the repairs but says he is only here to do the usb which he also says I have the part for which I don’t he said he knew nothing about any other repairs ie the collapsed sofa or doing another report for the leather that had faded away and peeled away and that it says on his worksheet that the customer has usb for him to fit .
He got on the phone to his office and then apologised for the wasted time and tells me they have lost previous reports so then he does another one he also said that the sofas have been made badly and the pigment in the leather is faulty and said he knew the recolouring would not last .
After he went I emailed hitachi personal finance and said that the sofas are not repairable and it is a manufactures fault and I would like replacement sofas or my money back which is a total of £2500 to date leaving a balance of £2000 to pay as this is no fault of mine .
Today 22 Feb 2019 I get a phone call from hitachi personal finance saying that homeserve can repair the sofas and it will take 6 hours to do at my home and they will try to recolour them again and that I can’t have my money back or a replacement suite as fabb sofas went into administration and they are just the finance company so I said ok send homeserve round again .
Please can someone help me here I would really like replacement sofas or my money back as I have been sold faulty goods but don’t know what to do next .

You're not going to get your money back or replacements, so bin that idea. You've had almost two years' use from them. You need to let them try and effect the repair they are offering. If it's not successful, then you might be able to negotiate a partial refund, taking into account the use you've had and resulting in an amount that would be similar to the sofas' used value today. You can put that towards buying replacements.0

I see what your saying but £4500 for sofas that only lasted 18 months untill the leather comes off and collapses and USB port broken is not good enough plus they homeserve technician has said it’s a manufactures fault I just don’t see the point of them keep coming out trying fix something that is unfixable to be honest it’s costing them £350 the next visit it’s ridicoulous as the problem is just going to keep happening and they will just keep having to fork out more money to homeserve .
They said I’ve got to keep paying the monthly payments but why should I when the sofas are faulty it’s just not fair I feel like I’m been mugged right off 0 -
Duck’s advice is sound.
You keep paying them as otherwise your credit will be affected and you will also incur interest or charges.0 -
Indeed. Stop paying and you'll have much more trouble to deal with.
You need to decide what to do. Continue to allow them to attempt to repair them or formally reject the suite and see what options they give you. I suspect the latter will involve you either keeping the suite and accepting a partial refund or them taking them away and you getting a slightly higher sum but the best you're going to get is the second-hand value of three items used for almost two years. A few hundred quid, perhaps?0
