  • Hi Gary, thanks for the reply. As stated, I'd made it clear to Allied that the earliest I could have paid was 13th and I paid manually on the 17th as I realized at this point it hadn't been paid.

    I appreciate your input, but I can't help but feel, you'll do anything to prove I am wrong, when actually, I think I am technically correct on this.
    After all the delays you had had before, why did you agree to pay on the 10th and then not do it?

    Do you not understand that they gave you so many chances to pay what you owe and you failed to do so?

    Can you honestly claim that you could not pay? Did you have a takeaway meal in all of those months, an alcoholic drink, a night out? Could you not have foregone these things to pay in time?

    Could you have taken a bar job on a Friday night or at the weekend? Could you have sold some possessions on eBay?

    So I think I probably haven't been clear, but heres what I know:

    June 29th: A letter was sent to me telling me my card was cancelled (I have rightly, or wrongly assumed this was a default summons).
    August 4th 2016: Allied contacted me and we agreed a repayment plan.
    August 30th 2016: I contacted Allied telling them I couldn't make payment on 10th as my salary was paid on the 13th. Some conversations were had and emails confirm I asked this and made it clear. I also have in email Allied stating the DD may still come out but to make a manual payment afterwards.
    October 11th: Allied attempts to take DD and it is returned.
    October 13th: I am paid and no attempt is made by Allied to take funds from my account to clear balance.
    October 16th: Allied instruct American Express that I did not make the agreed payment.
    October 16th: American Express file a default on my credit file.
    October 17th: Payment is made in line with the emails I had sent, stating this was my preferred payment date (This was sent on 30th August).

    So basically, it looks as though the account had NOT defaulted when it was with Allied - I have all the evidence to suggest it wasn't, however I fully accept that if a debt is sold - it would have been done so when account was in default, so perhaps you are correct and actually I will just have default date put forward.... However, if they cannot retroactively apply different criteria to the circumstances now than they did then.... they gave me till the 13th and I could have paid on the 13th, the fact that Allied did not correctly take payment is neither here nor there.

    A default is usually registered up to six months after you defaulted on the plan, so yes it probably wasn't until Allied reported it back. The DD was set for the 10th, it would not represent 2-3 days later. So it was not that the DD was taken early but that you did not get paid until after the DD date and even though that was agreed on the 4th you waited until the 30th to inform them. Allied stated that the DD may still present but you should make a manual payment, why did you not pay on the 13th and instead assume the DD would take it even though Allied said to make a manual payment for which you wait until the 17th. It looks like Allied waited for payments to come in before they informed Amex on 16th.

    The default is valid and I cannot see any valid argument for why the default should not have been registered. It's like why you informed them 14 days before your pay date that you could not keep to the DD date agreed 26 days before, surely you had confirmation before then. Was it because protocol is 14 days are needed to set a DD, so that was the latest you could tell them so that they should be able to change it to 13th?

    I am sure you will continue to push, and who knows as a goodwill they may remove it, but that does not mean you have a valid point or in anyway in the right.

    Well yes, and that is exactly how it should be.

    Your objection seems to be that the people who you are asking to lend you money are able to see what you have done in the past.

    I come at this from the opposite side you you, the banks who lent you the money set out the terms upfront, and honoured them, to the letter, whereas you failed to do the same and now ask that no-one be told of this.

    If you default then you cannot demand that anyone lend you money ever again, and you absolutely do not get to demand that you get to hide what you have done.

    The problems you had with money, they were not caused by the banks. I honestly feel that if you ever manage to take some responsibility for your own actions then you would be able to drop this silly campaign of yours and be in a happier place.

  • I think people are getting a little entitled here.

    I have a very good job and am very sensible with money... I earn over £60K a year and work in the city of London. I lost my job just before Brexit and I was in constant communication with AMEX etc as well as AIC.

    I told AIC I wouldn't be able to pay on the 10th of October, on the 6th August as well as the 30th of August.... I also attempted to call my rep on 7 occasions between this time. I did not go out boozing, or spend money on takeaways....

    All the people stating simply 'it's fair' and 'you did wrong' etc - I'd ask you to have all the facts and not make assumptions.... I know I broke my credit agreement, I've never stated otherwise. I know that AMEX were fair and gave me time to pay, again, I never stated otherwise.... However, given I articulated the 10th was no good (when the DD was automatically set for the 10th).

    I cannot tell you why I didn't pay manually on the 13th - it was 2 years ago - there was likely good reason. However, I appreciate I'll be lucky to have it removed....

    I just think the tone and manner of some of the responses is incredibly strong and pretty rude.... I'm not a bad person because I got into some debt, I had good reason and it was at a low point. I sold all my possessions, took some of my pension early to pay my rent in London, I went for 10+ interviews.... I'm not some idiot, I'm pretty well educated... It was a tough period and some of the responses show a serious lack of empathy....

    I was in finance, think companies were offering jobs in the summer of 2016?

    I can't just go and get a job in a bar, I was rejected twice for jobs far lower than me, once for being 'too qualified' and once because they told me I'd never stay as soon as I got another job....

    I've always been happy to answer questions - you've just been spiteful and obnoxious throughout all of this... Looking forward to what you'll come back with next.

    I've said on countless occasions people can disagree with me and that's absolutely fine - I may not win this and I may well be stuck with the default - if so, so be it.

    However, the manner of your responses is why I have called you obnoxious - not the response itself. I did lay this out for you before, however, evidently the written word is difficult for you to understand.

    So again, I'll ask you to refrain from making toxic comments across the boards and maybe find something a little more productive to do with your time.

    OP please dont feel the need to appologise, or to explain yourself, if anything, it should be me appologising to you, these are my boards, and i like to keep them running smoothly, and on topic, your post does contain some good advice for people in similar circumstances, but due to the subject matter, you will always get those with differing points of view, who are not too bothered how that view is expressed.


    These are open, public forums, most folk are courtious and understanding of other peoples situations, but there are others who are not, all i can say is please try to ignore the negative comments, and please carry on posting, replying to them only encourages more of the same.
