This is my first time well, ever writing in a forum asking for help. I received a PCN through the post from Euro Carparks in November 2018. I read online and it said to ignore which I have done. However, now they have sent a letter in the post from the "Debt Recovery Plus Ltd" and stating that they will take court action against me if I do not pay the 160 pound fine! Please help asap I'm a uni student and 160 pounds is too much. Thank you.

DRPL cannot take you to court, but ECP can , within 6 years in England and Wales
because you ignored it there is nothing that can be done for you at the moment
IGNORE drpl . they are powerless debt collectors
come back if you receive a formal LoC or MCOL in the post, within 6 years
the ability to pay (or not) is irrelevant
even skint homeless people out of work get taken to court and "fined" if they commit an offence0 -

Just read what you've said in the quote above, then go back and read your letter from DRP. Come back when you've analysed both and tell us how accurately you've read and reported the content of the DRP letter. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

So I can just ignore it? As long as the letters are from Debt recovery plus? Also thank you so much for your quick reply I really appreciate it0

yes, but not if you get a proper solicitors letter or a letter from Northampton CCBC on behalf of ECP
meanwhile , read post #1 of the NEWBIES thread as that tells you what you should have done when the NTK arrived last year
and post #2 of that thread tells you about court
post #4 of that same thread you have not read tells you about debt collector letter0 -
In the letter it states "If you haven't paid in full or made arrangements to pay by 19/02/2019, we'll pass your file to our client with a recommendation that they take court action against you"
- Debt Recovery Plus Ltd and I apologize I'm not sure if PCN and EuroCarPark notice in the post is the same thing.0 -
PCN is Parking Charge Notice (issuer is Euro Car Parks). Abbreviations also covered in the NEWBIES thread.Natwest OD - Start: £1,500 Current: £1,500 | Creation Loan - Start: £2,152.33 Current: £2,082.90 | Barclaycard CC - Start: £5,242.42 Current: £5,416.45 | Novuna Loan - Start: £8,598.43 Current: £8,366.04 | Tesco CC - Start: £9,420.22 Current: £9,885 | Northridge Car - Start: £15,584 Current: £15,017
Starting total on 02.07.2024 is: £42,497.40 | Current total: £42,267.39 (0.5% paid off)0 -
Ok I will be sure to keep a look out for the letters I receive and refer to the NEWBIE thread. Thank you.0

So DRP aren't threatening to take you to court then? Rather they will pass your file to their client with a recommendation........! Hardly DRP taking anyone to court.
And you seem to have not fully analysed the letter yet - how many times did DRP mention a £160 fine (take careful note of what I've written here)? Please note, we are not a legal advice forum. post #5 of the NEWBIES thread, clearly you have noth bothered to read it yet , or anything that is not fake news (like you read when the postal letetr came)
the only thread you need to read and digest is that NEWBIES FAQ sticky thread, nothing else
and yes , if they fail to sc@m the money out of you they WILL tell ECP to issue a court case, out of spite because they work on a no win , no fee basis
I do not believe they used the 4 letter F word on any of their paperwork, you made that part up, because what you received in the post (NTK) was an INVOICE0 -
The fee was mentioned once at the top stating "Notice of our intended court action - unpaid parking charge £160.00." I apologize but I do not understand the significance of the number of times the fee was mentioned.0
