IAS appeal help needed

Hi everyone,
I have received a PCN from UK Car Park Management Ltd back in December but my appeal was rejected. Since I appealed outside of the discounted period (I was traveling in December and did not get the notice before I left!) I am liable for a full fee. I have decided to appeal via IAS, but I have absolutely no idea what are my chances! And I am no lawyer so I haven't got much idea on the wording of a successful response to IAS.
Long story short, I did not pay £2 for the parking when attending a VISA appointment with my 21 month old son - it was on 6th December when the O2 major outage has happened. My phone was not working and I had no change. I made a call to leave my car at the parking as I was worried we will lose the appointment and will not get the documents for my son in time for out travels in January. I explained everything in my IAS appeal and uploaded the evidence. UK CPM are now claiming that because I parked at the restricted area I have contractually agreed to pay the parking charge notice.
How can I respond to that? Any suggestions are very welcome!

    Your chances of winning an appeal are somewhat lower than nil. An appeal is an exercise in futility.

    At the top of this board is a thread that tells Newbies to read it first. It explains the futility of IAS appeals and tells you what to do instead.

    The IAS is just a scam set up by the notorious Gladstones solicitors simply to scam motorists out of their money.
    Not even worth appealing

    UK CPM are one of the scammers of this scammers club.

    Just because they only want your money, they will not be interested in the O2 outage ..... we all remember and so do the press

    A court maybe somewhat amused by the stupid attitude of UKCPM and award you costs for the UKCPM timewasting

    Wait to see what UKCPM do, these scammers do read this forum.

    I'm afraid you're unlikely get any help here in writing an IAS appeal that is doomed to fail. It would simply be a wasteful use of energy by regulars, when there is absolutely no prospect of success.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • And just to add another good reason you shouldn't appeal to the scam that is the IAS, I didn't bother appealing to these scumbags and it made no difference to how things progressed, there is no law that states you must use the 'not fit for purpose' IAS.


    I beat the parking scammer that was trying to steal from me by a Landowner cancellation, always a first port of call for everyone!

    I naively did appeal to IAS. It was a bruising and time wasting experience. Better to spend the time on defending a claim. They will not take any mitigating circumstances into account. They will say that whilst they sympathise with your circumstances you did not display a valid ticket.

    You are welcome to read my main thread if you want to see an example of the sort of reply that you will receive from them.

    You need to have a good look at the signage both at the entrance to the car park and in the car park itself. It's the signage that forms the contract or not if the signage is not clear enough.

    You have not made any convincing appeal point in your thread. I agree IAS is a waste of time and you would be better employed in findind fault with the signage in anticipation of court.

    Your initial appeal letter might be produced in court and from what you have written, the problem lay 100% in your court, not failing of the PPC. No change and O2 outage is not their problem.

    So, find something that is their deficiency or you would lose.

    The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    Was the car park attached to the premises that issue visas? If so, you know who to go send your (assertive) landowner complaint to. Presumably the office would not have wanted applicants to be late for appointments while looking for alternative parking, they probably work to a very tight schedule.

    Make the relevant party cancel this thing. Failing that, sit tight and see UKCPM in court. Heavens, that last bit sounds dramatic! But since hanging out here I've come to realise that the parking scam court stage isn't the big deal it sounds like.
