smart parking charge notice

  • I have an update > I contacted the ceo of Laura Ashley who has said they will try and contact smart parking and try to get them to cancel the charge, ceo of dreams yet to contact me.
    However, smart parking have been sending all correspondence to the incorrect address, hence in the delay of me receiving news of the initial PCN, I did not update my logbook with the upto date add of my new residence. I have just found out they have passed on the notice to debt collectors who are demanding the fine of £170 to be settled, letter dated 13/2/19.
    I did file the appeal with smart parking directly last night and the web page did allow me to proceed with the appeals process, I am a little concerned now that they will refuse to accept appeal as the 28 days from the original notice has passed and they have passed it onto debt collectors. Can anyone give any advise, I am now worried the fine will continue to increase!

    it wont increase, a typical loss in the small claims court is about £175

    we already gave you advice, the advice hasnt changed in just a few hours

    find out who manages the retail park and complain


    its not their fault they had the wrong address, the legal onus is on the keeper to notify the DVLA of any changes to their V5C and/or DRIVING LICENCE promptly, or face a possible fine of up to £1000 for each offence (so not SMART PARKINGS fault)

    I was just concerned smart parking would no longer consider the appeal as it was passed to debt collectors.

    they may not, due to the time delay etc , hence why its important to avoid DVLA fines and keep your details up to date, for your driving licence as well as the V5C


    THIS IS WHY ITS EVEN MORE IMPORTANT TO GET A LANDOWNER OR RETAILER TO CANCEL IT (OR THE M.A.)

    If the PPC do not now have the correct address, send a letter/e-mail to the DPO of the PPC as a data correction notice and give them the correct address for service and tell them you require them to delete your old address from their records.

    I assume you put your correct postal address in the appeal page?
    i am assuming they cannot prove the person appealing is the actual driver of the vehicle?
    I also assume your were the keeper named on the PCN letter, thus you appealed as registered keeper?

    Should be fine to get a POPLA code, as long as you appealed only a couple of days after day 28.

    Should have done it sooner thought, there was no issue to ask about (cases at this stage are all the same, as the sticky thread tells you) and the template appeal was there for you to use, as soon as you found this forum.

    Keep pressuring the retailer CEOs for an update, and Google for the retail park Agents. As long as the retail park has a name, it's easy to find who runs the place. some of them even have a website for the retail park, with a contact listed.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
