Bmw Recalled for 5 weeks - What are my rights?

Find out whether you've paid 50% or more of the total amount payable, as specified in your agreement. If you are in this position then you can simply VT the contract and walk away.
I could VT if I wanted, however I put in £8000 up front as deposit which is aqjivalent to £222 a month. If I VT now I'll walk away losing the equivalent of £1000 of deposit for the remaining 5 months and any excess mileage charges (about £1000 but has been budgeted and any wheel refurb).
I fully intend to see out my agreement, however I'd rather not be paying for a car that I can't drive.0 -

Your point had nothing to do with discussing their legal obligations which was the point of my original post?
Instead, it revolved around you hypothesising that I should be satisfied with an Astra as an alternative to a 640d, on the basis of market value alone.
I appreciate you taking the time to input, however I tried to be as detailed as possible so that discussion could be focused on discussing the obligations of a Manufacturer Owned finance provider, in the case of a PCP contract where they have no-voluntarily withdrawn the vehicle from the still paying customer.
If you have anything to add around this, please by all means, but speculation wasn't what I'm looking for.0 -

You still don't get it. They are under no legal obligation to provide a like-for-like (or even "fair") vehicle, more so you are under a legal obligation to mitigate your losses. There's nothing wrong with the car you've been given.
Whilst potentially not the answer I want, this is still useful - Do you know where I can find out more about the responsibilities of a manufacturer/finance provider in such a case?
The second part is subjective - Whilst mechanicaly there's nothing wrong, from a performance perspective its inadequate for the long (4+ hrs) trips that I do through work. The seats are causing me back pain and there's no Heads up Display, which I would consider as a safety feature.0 -
I don't get your point, your deposit has already gone, the only thing your higher deposit has done has reduced your monthlies and put you in a position to VT earlier. If you're not planning on keeping the car then simply VT and move on.
See it more as I've already paid 220 of the 580 a month the car costs - Even saving the 360 a month on monthly payment, I would still have to face the cost of paying the £220 a month to the end of the agreement (even though this was paid up front).
I would rather pay the 360 a month and see the 580 of value than lose the 220 of value each month completely.0 -

oh sorry - i now see your point.
yeah you defo deserve a full refund, refund of any monies paid, compensation for your time and abit on top of that too.
They should defo take into consideration its a 75k car new too - forget that its 5 years old - that's entirely irrelevant.

Your logic is ridiculous.
Let's forget that it's a BMW, let's pretend it's a Bentley, 6 years old with a similar issue. The owner has just been chucked into Ford Mondeo and you would be the equivalent of saying 'The Ford brand new is the same as what the Bentley is now worth, so they are being totally fair putting you in a Ford."
The fact that every thread to do with this issue doesn't contain any discussion around the rights of someone in a PCP agreement in such a situation is a testament to how toxic the community is.
The very fact that you were posting about delay repay because your train (like my car) was disrupted (like my car) and you were forced to use busses instead (like my courtesy car) which left you unhappy and feeling that you weren't getting what you had paid for (like me) is pure hypocrisy. Imagine you had to take the bus for 5 weeks and were told to pay your train fares, and try telling me that you shouldn't get compensation despite them offering 'alternate transport' and 'keeping you mobile'0 -

What, the one I posted on, said I wasn’t too fussed, and decided an hour later it wasn’t worth the hassle? That one?
