Worth going to popla?

Sorry am new to this, if I’m wrong posting this.

Below photos are photos of signage in the car park I received a fine for.. are they ‘adequate’?

Wondering if it’s worth going to popla?

Bare in mind as you drive and turn in the main sign is as you pull in and angled to the other way and you don’t have a chance to see it when pulling in and concentrating. Also the other signs are in the corners and one is even facing outside of the car park onto the pathway?!

Your first photo, and the third from last and the penultimate one, are a good view of a car park without clear signs, so I'd use those only at POPLA.

Anyway, this looks like CEL, so presumably your first points will be 'no keeper liability' then 'no landowner authority'. Then signage last.

What was the contravention, not paying, why not? Was the car only there minutes?

Just ignorance of the signs to be honest as they aren’t great!

Do CEL not have landowner authority usually?

    Thanks

How long is a piece of string? It's impossible to tell unless they do or don't produce a valid contemporary contract with the landowner. There are a couple of sites where they have failed at PoPLA for not producing a contract, but you would have to trawl through the PoPLA results thread from the last page to see if your site is one of them

Put it in anyway along with all the other points mentioned by C-m plus any others that may be relevant from post 3 of the NEWBIES.

They are bound to have it, but they aren't keen on fighting long POPLA appeals and showing their landowner authority.

That's why the third post of the NEWBIES thread gives you POPLA templates.

These are not fines, so if you are complaining to anyone make sure you use the correct terminology, to avoid shooting yourslef ( or anyone else) in the foot

Also post your compaint here first, and never try and guess as to who may have been driving that day.

Dont say things like He parked/She parked/My Mum/Dad/Wife/Sister/Brother/Friend.
refer to it as the vehicle entered the car park, and parked/stopped/stayed/drove back out again/whatever.

And finaly is your name Lucy with your last name starting with the letter S by any chance? nota huge issue, but tread carefuly, in particular pay atention to the paragraph above.

Do that BEFORE trying POPLA, never never the other way around.

  • Hi Lucy

thanks for these, they could prove invaluable! It's clearly a money-making exercise. I couldn't particularly remember the car park - I had a cousin with me who's got mobility issues and simply popped-in to pick up some groceries for her. Didn't realise at all that I needed to pay.
