It is all through a website. You didnt see anything abotu a hearing, because there is not one. If there is no hearing, then it cannto be in person.0

Apologies again, I had another question relating to something I can;t quite understand from the faq\guidance:
The template first appeal, says to appeal as the keeper and provide the name and address of the keeper (for a BPA organisation).
Does this not then mean that UKPC need not apply to the DVLA for registered keeper details (since the keeper has provided them themselves)?
I note that Schedule 4 of POFA says “keeper” means the person by whom the vehicle is kept at the time the vehicle was parked, which in the case of a registered vehicle is to be presumed, unless the contrary is proved, to be the registered keeper;, so I presume it is something to do with that, though I can't quite get my head round when "keeper" and "registered keeper" would be different?

Yes the point of appealing a windscreen PCN on day 26, as keeper, is to stop UKPC from remembering to apply to the DVLA for registered keeper data. Usually works!
They can only use the POFA, if they got the rk's data from the DVLA (not from you).
Expect a 'reply' asking who was driving. PLEASE DO NOT POST HERE ABOUT IT.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So having followed the advice on here, template first appeal was sent via e-mail on day 25/26 after windscreen PCN and acknowledgement e-mail received same day.
It is now day 56 and no NTK received and no reply to template first appeal ( spam checked etc). Having checked on the website charge is still 'active'.
Is the strategy now to continue to do nothing? Or do something to head off any dirty tricks around any claims of a POPLA code e-mailed weeks ago which has expired? Thanks0 -

and complain that UKPC have breached the CoP by failing to respond to your appeal and failing to send you a POPLA code. The top email is to alert Steve Clark at the BPA and to put a bomb under UKPC, who will probably then miraculously cancel the PCN.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

OK - NTK now received today (18 Apr) dated 15 Apr. Given that the parking charge was issued 17 Feb, I think this is out of time for POFA?
The keeper had the presence of mind to have themselves filmed whilst opening the letter, but I think it is out of time even if going by the date of the letter, rather than date received.
Doesn't appear to have a POPLA code though.0 -

Yes, that NTK is too late. I'm guessing it says something weird halfway down about 42 days (nothing that appears in the POFA?).

Yes there is nothing about keeper liability or POFA in the letter, but instead it says:
"UK Parking Control Ltd do not know the name and address of the driver. We therefore invite you, the Registered keeper, to pay the Parking Charge or provide us with the name and current address of the driver so that we may write to them and request payment; and you should also pass this notice to the driver"
"If, after a period of 42 days, (beginning with the day after this Notice is given), the amount requested in this Notice has not been paid in full (or we have not been informed of the driver's name and current address) the charge will be passed to our debt recovery team, and further charge of £60 incurred".
At the top right of the letter it says (in very faint writing): NTO/England/NONPOFA/07-2018.
The letter goes on to say about the appeals process (to UKPC within 28 days and then to POPLA if they reject), but with no reference to the original dispute raised by the keeper on day 25 after the windscren ticket (now 38 days ago).
Is the strategy simply to ignore this NTK, and complain to BPA and UKPC about the non response to the original dispute raised, with a view to extracting a POPLA code? Or is it worth pointing out the non-compliance of the NTK to UKPC at this stage - in a "you can't touch the keeper and the driver won't be named" type e-mail.0
