    just a quick note

if the council have sent the baliffs before going to court i have heard that it because they dont stand much chance of getting it through the courts
    for example
the letters havent been issued in the correct time/manner
    addressed incorrectly etc..

and they are just trying their luck of selling the debt on in case you pay,..##

just check all your documents that they are to the correct person at the same address and no one else of simliar names they have mixed you up with someone else (one of the main reasons gets thrown out of court)

Thanks for your help, I said to the bailiff that the council had said we would hear from them via the court but we hadnt heard anything, the bailif replied saying they had already taken us to court and the bailiffs company had also written to us (at the time I didnt think to ask what address they had writen to as was gobsmacked), I said we had never recieved anything about this since last dealing with the council in august and that was when he said to call the council in the morning and then to call him back so he could then come and make a note of our possesions. As far as I am aware (just by recieving post for prev occupiers at my old address) no one has anything like the same surname as myself and OH.

Hey, dont ever think that about yourself!! Think of it like this, you cannot be ugly or not good enough otherwise she wouldnt of made a baby with you. You must have lots of good qualities about you otherwise your ex wouldnt of gone anywhere near you.
I am sure that one day your daughter will come and find you and when she does she will be proud that you are her Dad.[/quote She probably wont find out who i am. she hasnt put me on the birth certificate, and she told social security she doesnt know who the father is
If she wants to find you I am sure she will as I havent seen my father since I was 4 and am trying to trace him at the mo and I dont have his definate name either.
Surely there must be a way you can prove you are her father?
You sound like a veyr caring father and I truely hope that one day you get to be the father you deserve to be.

  • What happens if I am overpaid Housing Benefit?
If we find out that we have paid you too much benefit we will look at the circumstances and decide if it is recoverable and, if so, from whom
If we have paid your benefit to your landlord on your behalf we may recover the overpaid benefit from your landlord. What council do you owe money to? they all seem to have different rules
  • Iwent to a solicitor and i went to mediation, but she refused to go. the solicitor asked her if i could see the baby once a week and she refused. and my benefits just go over the mark for legal aid. They said i had to pay £80 a month until the case got to court and i couldnt afford it. My ex sent me a text saying "you are the father but you will never be the daddy" and she said she is going to use my illness against me if i go to court.

Would rather not say what council on here but the benefit was paid directly to us as I'd rather have it that way as know how much we had to pay towards the rent out of our wages.
I had noticed from using Ask.com that they all seem to have different rules but am pleased that the arrangement for paying that back (even though it wasnt our fault) seems to be keeping them happy for the time being.

They cant use your illness against you in court. Dont give up, where theres a will theres always a way.

I just wanted to add hugs and hopes for a better tomorrow as I'm going through the same thing myself (bailiff and council tax). Got two young children (5 and 2) and suffer from PND too. Some of the things posted in this thread have really struck chords with me, esp. the stuff about feeling useless and ruining xmas.

My daughter's birthday is the end of the month and she will be 6. I told her months ago that she could have a birthday party for the first time this year, but just can't do it now. So I explained to her that we'll have a joint one for her and her brother after Christmas (I get student money then, thank God), expecting her to sulk and kick off. She just looked at me and said 'it's ok mummy, I don't mind waiting til then'. Stunned me and broke my heart at the same time.

Also feel completely useless at the mo, esp. as my partner works away Mon-Fri and I have to just get on with it. It's really difficult, being at Uni, trying to study at home, all the travelling, childcare to sort out. Was in bed tonight and couldn't sleep, thinking 'they'd be better off without me, this is all my fault'.

Was my birthday yesterday - spent most of it panicking and in tears. What a great day!

    Katie
