Freehold Purchase - Land Registry Entries

Hi All,

I have asked this question to my Solicitor this evening but as am impatient bod I thought I would ask the question on this board as well, to see if I could get clarity on my question.

In 2015 I purchased a leasehold house. In December 2018 I then purchased the freehold to the house.
Today I have received the a copy of the completion of registration document from HM Land registry showing me as the proprietor of the freehold :j

However at the end of the document it shows under "Schedule of notices of leases" the lease that I have just bought myself out of.
This has another land registry title reference, which is the Land registry entry for my house that was entered upon purchase of the property.

Having checked the land registry entry for my house it still shows two entries, one for the freehold and one for the leasehold.
Having bought copies of both entries today, the Freehold entry it shows me as the proprietor, with no lender, but still with a notice of lease, with a title entry. The leasehold title entry is as per it was before the purchase of the freehold.

I thought the process of purchasing the freehold would have done the following in relation to land registry:
1) registered my as the owner of the freehold, (which it has)
2) transferred property and the existing charge from the leasehold title to the freehold title (as I completed a Deed of Substituted Security)
3) Then closed the old lease title. (which would remove the lease from the schedule of notices of lease on the freehold entry)

Am I wrong with this assumption?

    You could apply to have the leasehold removed such that you own soley the freehold.

    however since (I assume?) you have a mortgage on the lease you bought, with a Charge registered agsinst the leasehold title, you will have to get the mortgage lender involved to permit the Charge to be transferred across to the freehld.

    Either do nothing and retain both Titles, or go through the process (and cost) of removing the leasehold title.

    Hi G_M, Thanks for the reply.
    I do have a mortgage on the property, but when I went through the purchase of the freehold I completed a deed of substituted security for the mortgage. I thought this essentially was to transfer the mortgage charge from the leasehold entry to the freehold entry, thus enabling the leasehold entry to be removed.

    Ultimately I think I just need to stop being impatient and wait for my solicitor to respond.:rotfl:
