  • I've uploaded my draft to WeTransfer. Please let me know if you have any problems downloading it.

I've put in what pointed at @Coupon-mad. I'm not entirely confident I've done it correctly, but the points are in.

Please could I have some feedback.

It feels a little like War and Peace and I've only put in some points from my Defence Statement!

Do I need to add in the various 'Beavis', POFA references as appendices or will abbreviated sections surfise?

I've sent the other half out to get a ream of A4 and a ring binder!

Add them as exhibits but only use the relevant a pages or sections , not the whole thing

Also add a costs schedule as part of the exhibits and refer to it in your WS

To be clear , your WS references the exhibits plus Costs schedule , which are attached
  • Sorry for being so inexperienced in this... the claimants' cost schedule?
I listed what is on the PCN which outlines how they see their costs developing...
It's in the Word doc on the WeTransfer link if you want to have a look at it.
    Thanks

I don't need or wish to look at the paperwork , thank you

It's YOUR costs schedule , as detailed in dozens of other court cases on here plus by loc123 in the Newbies thread , so your costs , not the claimants costs

Read other threads like the cec16 thread , plus the one where coupon mad tried for something like £500 and wasn't awarded them due to not filing the costs schedule with the WS (so not filed early enough)
  • Thanks for that. I’ll look it up.
This has taken a long, long time to do!

Doing what we do which is reading other recent court cases will help you , don't just stay on your own thread , you won't learn anything

Put a well known record by Queen into the forum search box to find completed cases , which will contain the title of the song

AOBTD is a hint to that title
  • Bom, bom, bom, AOBTD hey hey.
I’ll look it up very shortly.

Costs schedule example, split into two types of costs (the second section is rare but worth trying for, but only granted if you reach the high bar of convincing the Judge about the Claimant's unreasonable conduct, which needs you to have a crib sheet to read from when you win, running through everything they did wrong, or late, or unfairly including trying to claim £160 that they knew was not recoverable):

  • Thanks Coupon-mad. I’ve got all that in. I’ve emailed and posted (with proof of posting) to SIP, with my costs letter and I’m on my way to court to hand deliver my well presented ring binder. I’ve also told SIP that I’d like to delay the hearing. I’ll check with the court when I get there to see if there’s any movement on the date... fingers crossed.
  • Morning! I thought I'd put an update here.
I was unable to make the court hearing on 21 November due to work as previously explained. I told the judge and submitted my bundle. The judge went in favour of SIP Parking but didn't award them the additional £60 administration costs. Think the judge may have read my bundle and took into account:
9.2. According to Ladak v DRC Locums UKEAT/0488/13/LA the claimant can only recover the direct and provable costs of the time spent on preparing the claim in a legal capacity, not any administration costs allegedly incurred by already renumerated clerical staff working for a private car parking company in issuing robo-claims. So thanks Coupon-mad
I put this in at the death on the advice of I now have a fine of £100 and £50 court costs. However, I have not been sent any method of payment, and have not heard from the court or SIP since... what should happen next?
