Next Refund

I bought some boots and because they weren't available in my size they said they would order them on line for me
I paid to have them delivered to my home

Boots arrived one 6 and one 7 Phoned and they were very apologetic said to send them back by Hermes parcels

A week later they are telling me the only way I can get a refund is to go back to the shop 7 miles away and 3 buses Where do I stand on this I just want money refunded to my card The shop has all my details and so has Next They say they cant do it I do have an account with them

    Bit of an odd one, I'm guessing you paid in store? In that case you need to go back to the store for the refund. It was your choice to buy from that store.

    If you want a replacement pair then remind them that they are liable for costs incurred with that replacement.
    (2)If the consumer requires the trader to repair or replace the goods, the trader must—
    (a)do so within a reasonable time and without significant inconvenience to the consumer, and

    If you want a refund then remind them that unless you agree to return rejected goods, your only obligation is to make them available for collection - at your convenience and their cost. Even if you have agreed to return, its still at their cost.
    (7)From the time when the right is exercised—
    (a)the trader has a duty to give the consumer a refund, subject to subsection (18), and
    (b)the consumer has a duty to make the goods available for collection by the trader or (if there is an agreement for the consumer to return rejected goods) to return them as agreed.
    (8)Whether or not the consumer has a duty to return the rejected goods, the trader must bear any reasonable costs of returning them, other than any costs incurred by the consumer in returning the goods in person to the place where the consumer took physical possession of them.

    Next have always been a bit of an oddity when it comes to their stores and online presence. They are, and always, essentially been two companies, a traditional bricks and mortar store and a separate catalogue company, now exclusively online. I think you're you're going to save yourself a lot of hassle and time if you simply go back to the store and change them, it's not as if you're never going back to the shops in the future is it.

    OP can't change them ... they've already been sent back. ;)

    OP - you need to go to the store so they can refund to your card*. They won't (probably) hold your details via the online system to be able to credit the refund electronically, so you'll need to insert your card into a terminal. As said above, the costs you incur in doing this (sending them back, and going to/from the store) you can recover from Next as this "loss" has been incurred due to their breach of contract.

    * On the subject of paying - did you put your card into a store terminal to make the payment? Or did you enter your details (including making payment) online at the store? The answer will guide us as to whether what I've said above is correct.
