2 CCJ on credit file (CEL) PEASE HELP!!

  • From what I believe one of them was me overstaying in the car park and 2 photos were taken as evidence showing the timing entering and leaving the car park. I must have over stayed around 50 minutes.. as the first hour is free. The other one I have no idea about.

    So shal I go forward with set aside application then? I will certainly be checking if I’m eligible for help with Set aside costs x2.. thank you for that piece of info...
    What are my next steps?
    As I don’t think I have much time left (few days)

    Losing a set aside application here is almost unheard of, so an odd one by a bad Judge who blames the victim, not the scammer, is just a sad blip, and not one to worry about.

    We see set asides won almost every time and I can only remember one other loss.

    Showing you have a defence is not what a Judge will mainly be looking for.

    if you dont know what these pcn,s were for , then send the DPO at CEL a SAR by email and get all their data on you (if you havent done it already)
  • No problem I will be composing a formal SAR letter to CEL requesting info on fines.
    But .. if they (CEL) don’t reply in time is it ok for me to just go ahead with my set aside applications anyway? Because iv read somewhere that I must give the company atleast 1 calendar month to respond. But I find that If I was to then I have to submit the set aside application within 4 days as any longer would exceed the 2 week period from when I first contacted court regarding CCJ?

    the set asides wont rely on you getting a SAR reply


    but any defence might


    set asides need to be done quickly, asap or sooner

    All letters and emails sent, including any appeal correspondence earlier.

    All photos taken of vehicle.

    If the car parks were pay and display, If so, PDT machine record from that day of payments made.

    All data held, and a full copy of the PCN, NTK.

    IMPORTANT – A list of all PCNs considered outstanding against me (registered keeper) and any claim must be for all PCNs in one claim, NOT several separate claims.

    If you need any more data from me, or a fee, please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month. If a fee is required, then I expect all of the information requested to be ready before making payment, please also note that any fee paid for information requested will be included in the claim for set aside court application fee.

    If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member.     You need to focus your energy on getting a set aside. An application must be made promptly upon discovery of a ccj.

    Time is now of the essence.
  • Okay so should I just complete the set aside application and send it off? Do I need to send money with the application?
  • I have some questions.....

    As I have 2 CCJ on my name from the same company is it possible for me to send a set aside application with BOTH claim numbers in one application? Rather than making 2 separate applications?

    I need some support on creating a witness statement/defence as I have no idea where to start? Could someone please compose one for me? If possible I can give info
