2 CCJ on credit file (CEL) PEASE HELP!!

  • Sorry, the ones which I ignored were the parking notices not the court letters.. it’s a kind of messed up scenario as some letters I seen and some I didn’t. When the letters got to the county court phase I was already out the house.. So yes I did ignore the first bunch but not the court ones. Is there a way around that?
  • Can i ask if you think the parking charges were legitimate in the first place. As in, did you over stay, not buy a parking ticket etc?

    The reason I ask is that I am currently being threatened with court and it's the company's error not mine. I was parked correctly, with a valid ticket and returned with the time period.

    So if they were wrongly issued, you would have a case there to fight I imagine?

    If you didn't ignore the court papers, what exactly did you do with them on receipt?

    If you didn't get the court papers then you stand a reasonable chance of getting a set aside. If you knew about them your chances are significantly diminished.

    As I said earlier though parking companies monitor this forum. Forum posts have been produced in court to incriminate posters.
  • The court papers Ofcourse I didn’t receive them other wise I would have sorted this matter at first hand. I wouldn’t let it get to this stage.. all other notices were ignored tho.

    then your set asides will be based on that premise, that due to moving the court papers had been sent to an old address and this is the first hint that you had a CCJ against you when your credit check failed

    that is the usual basis for set asides to succeed, assuming a judge agrees

    Yes.

    Firstly do you qualify on income grounds for help with the £255 set aside court fees x 2? Check by Googling it, as if you do, you must certainly try (nothing to lose)! Anyone with a scam CCJ who can do a set aside free of charge or at minimal cost v a rogue parking firm, must give it a go.

    Not receiving the claim forms is a reason to set aside as long as the Judge believes you didn't receive the claims/didn't ignore them and therefore, were denied a chance to defend.

    All CEL cases are defendable and potentially winnable if you can get the CCJs set aside.

    IMHO, all private parking PCNs are a scam.

    All defendable, all not legitimate in one way or another - the industry should be illegal because they do nothing whatsoever to 'manage parking' anywhere.

    I agree with you! But unfortunately I have just read another thread where a member challenged a CCJ on the basis of not living at the address but the judge rejected it as they should have updated address with DVLA & they admitting to be at the hotel car park at time of PCN.

    So from that I was thinking the best way out of this would be to prove the parking charge was not valid in the first place.
